Code Enforcement Hearing <br />Minutes, May 16, 2424 <br />Page 5 <br />inspection report was from February 29, 2024, to point out that this has been going on in a notice fashion <br />since February (2024). <br />The Special Magistrate stated that the property has numerous violations going back to February (2024), <br />there has been progress, there were thirty-six violation and now it is down to about twenty-six. The Special <br />Magistrate did not hear in the plan, a specific date as to when the violations will be resolved. The big <br />concern is the risk to the community, as the fire department pointed out. And the individuals on the property <br />itself. Ms. Acevedo submitted emails from the planning department, dated December 2023 showing the <br />City has been working with the business so the property can come into compliance, and it has gotten worse. <br />Ms. Acevedo advised that the City would continue with the seven days for compliance. <br />Ms. Nix asked the Special Magistrate that for violation 2-5.3 to add the wording that a site plan must be <br />applied for and received from the City. <br />Special Magistrate Ruling: The Special Magistrate made a ruling that the property was in violation of the <br />violations presented, given the safety concerns it was ordered that the property come into compliance within <br />seven days (May 23, 2024) for the property to be remedied, for City Code 2-5.3 the site plan must be applied <br />for and received from the City. A Subsequent hearing will be held on June 20, 2024, to determine if <br />compliance has been achieved. <br />New Cases <br />CE -24-000446: New Case at 686 Jasmine Road <br />Violations - City Code 3-10.9.e.2.a.I Residential Designated Parking. $50.00 per day fine requested. <br />City Code 3-10.3.a.4 Roofs, gutters, down spouts — maintenance. $50.00 per day fine requested. <br />City Code 3-10.9.f Unlicensed and/or Inoperable Vehicles. $50.00 per day fine requested. <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-000446, located <br />at 686 Jasmine Road. The property was reinspected and found to remain in violation on March 13, 2024, <br />The City requested a correction date of May 30, 2024. If there is no compliance by May 30, 2024, then the <br />fines requested should be imposed for each day of non-compliance thereafter. The City requested a <br />subsequent hearing date of June 20, 2024, to determine compliance. The Special Magistrate asked if there <br />was anyone present to speak about this case. There was no one present to speak about this case. <br />Discussion: There was no additional discussion. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that found the property in <br />violation of the three violations presented. Respondent shall cure the violation by 1:00 p.m. May 30, 2024. <br />If there is no compliance by May 30, 2024, then the fines requested will be imposed for each day the <br />property remains in non-compliance. A Subsequent hearing will be held on June 20, 2024, to determine if <br />compliance has been achieved. <br />CE -24-000738: New Case at 1440 X..ake Shore Drive <br />Violation — City Code 3-10.9.c.1.a Recreational equipment (utility trailers, RV, camper, atv, etc.). <br />Staff Presentation: Micelania Acevedo Code Compliance Supervisor gave testimony for case CE -23- <br />000738, located at 1440 Lake Shore Drive.
