Code Enforcement Hearing <br />Minutes, May 16, 2024 <br />Page 6 <br />on May 13, 2024. The City requested a correction date of May 30, 2024. If there is no compliance by May <br />30, 2024, then a fine of $75.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requested a subsequent hearing date of June 20, 2024, to determine compliance. The Special <br />Magistrate asked if there was anyone present to speak about this case. There was no one present to speak <br />about this case. <br />Discussion: There was no additional discussion. <br />Special Magistrate Ruling: The Special Magistrate made a finding that the property was in violation of <br />City Code 3-10.9.c.l.a It was ordered that the Respondent shall cure the violation by 1:00 p.m. May 30, <br />2024. If there is no compliance by May 30, 2024, then a fine of $75.00 per day will be imposed for each <br />day the property remains in non-compliance. A Subsequent hearing will be held on June 20, 2024, to <br />determine if compliance has been achieved. <br />CE -24-000832: New Case at 1040 Osceola Trail <br />Violation — City Code 2-7.10.a Fence permit required. $100.00 per day fine requested. <br />City Code 3-10.9.e.2.a.1 Residential designated parking. $50.00 per day fine requested. <br />City Code 3-10.9.e.2.c Residential Designated Parking -Blocking Sidewalk. $50.00 per day fine requested. <br />Staff Presentation: Tyler Hall Code Compliance Officer gave testimony for case CE -23-000832, located <br />at 1040 Osceola Trail. The property was reinspected and found to remain in violation on May 13, 2024. <br />The City requested a correction date of May 30, 2024. If there is no compliance by May 30, 2024, then the <br />fines requested should then be imposed for each day of non-compliance thereafter. The City requested a <br />subsequent hearing date of June 20, 2024, to determine compliance. The Special Magistrate asked if there <br />was anyone present to speak about this case. There was no one present to speak about this case. <br />Discussion: There was no additional discussion. <br />Special Magistrate Ruling: The Special Magistrate made a ruling that the property was in violation of the <br />three City Codes presented and should correct the violations by May 30, 2024. If compliance is not met <br />then the fines requested should be imposed, if the matter is not resolved by May 30, 2024, it will be brought <br />for a subsequent hearing on June 20, 2024. <br />Subsequent Case in Compliance <br />CC -23-003839 640 Diane Circle <br />Violation — City Code 3-10.9-.c. La Recreational Equipment (Utility Trailers, RV, Camper, ATV, ETC). <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that the above violation was <br />in compliance.
