CASSELBERRV CITY COMMISSION <br />Minutes of June 10, 2024 — Regular N4ecting <br />Page 14 of 20 <br />OFFICIAL ZONING MAP AND CHANGING THE ZONING CLASSIFICATION FROM <br />CASSELBERRY OR (OFFICE/RESIDENTIAL) TO CASSELBERRY CG (COMMERCIAL <br />GENERAL) FOR ONE PARCEL LOCATED AT 2035 HOWELL BRANCH ROAD, TOTALING <br />APPROXIMATELY 1.46 ACRES, AND CHANGING THE ZONING CLASSIFICATION FROM <br />SEMINOLE COUNTY OP (OFFICE PROFESSIONAL) TO CASSELBERRY CG <br />(COMMERCIAL GENERAL) FOR ONE PARCEL LOCATED AT 2075 HOWELL BRANCH <br />ROAD, TOTALING APPROXIMATELY 1.79 ACRES, AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1602 <br />was advertised in the Orlando Sentinel on Friday, May 31, 2024. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.04](4), Florida Statutes. <br />Staff Presentation: Planner I Hunter McFerrin stated that Ordinance 24-1602 amends the Official Zoning <br />Map Designation for one (1) parcel located at 2075 Howell Branch Road (Parcel Identification Number 28- <br />21-30-300-0280-0000) from Seminole County OP (Office Professional) to City of Casselberry CG <br />(Commercial General), and for one (1) parcel located at 2035 Howell Branch Road (Parcel Identification <br />Number 28-21-30-538-0000-0020) from City of Casselberry OR (Office Residential) to City of Casselberry <br />CG (Commercial General). The subject properties, addressed as 2075 Howell Branch Road and 2035 <br />Howell Branch Road, consist of approximately 1.79 acres and 1.46 acres, respectively. The parcel located <br />at 2075 Howell Branch Road was annexed into the City of Casselberry in February of 2024 and an <br />amendment was made to the City's Future Land Use Map for the property to establish a Future Land Use <br />Map designation of Commercial (C). The applicant intends to develop both parcels with commercial retail <br />spaces, and to proceed with that development an amendment to the City's Official Zoning Map designation <br />for the two parcels is required to establish a consistent zoning district. The Planning and Zoning <br />Commission, acting as the City's Local Planning Agency (LPA) voted unanimously at its meeting on April <br />10, 2024 to recommend approval of the requested zoning amendments for the two subject parcels to the <br />City Commission. The request to amend the City's Official Zoning Map designation for the subject <br />property located at 2075 Howell Branch Road from Seminole County OP (Office Professional) to City of <br />Casselberry CG (Commercial General) and the subject property located at 2035 Howell Branch Road from <br />City of Casselberry OR (Office Residential) to City of Casselberry CG (Commercial General is consistent <br />with the City's Comprehensive Plan and the Commercial Future Land Use Map (FLUM) designation; is <br />compatible and consistent with the surrounding mix of land uses and zoning districts; and City water and <br />sanitary sewer services are available to the subject property. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 24-1602 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1602.
