CASSCLBERRY CITY COMMISSION <br />Minutes of June 10, 2024 — Regular Meeting <br />Page 13 of 20 <br />that the PMX-HIGH zoning designation provided for allowing up to ten (10) stories, but the proposed <br />project was currently at five (5) stories; that the maximum density allowed was eighty (80) units per acre; <br />and also, that the proposed zoning designation allowed for the highest and most intense impervious surface <br />ratio (ISR) of up to 90%. The City's Development Review Committee (DRC) approved a revised Concept <br />Plan for PUD 24-01 on March 21, 2024, and the Planning and Zoning Commission, acting as the City's <br />Local Planning Agency (LPA) voted 4-0 at its meeting on April 10, 2024 to recommend approval of the <br />zoning amending and the revised PUD Agreement to the City Commission. The request to amend the <br />City's Official Zoning Map designation for the subject property to PMX-HIGH (Planned Mixed -Use: High <br />Rise) and to approve the related PUD Agreement and Concept Plan is consistent with the City's <br />Comprehensive Plan and the MTMU Future Land Use Map designation; is compatible and consistent with <br />the adjacent land uses and zoning districts; connections for City water and sanitary sewer services are <br />available to the subject property; and the proposed apartments are age -restricted, so a school impact analysis <br />from Seminole County Public Schools was not required. However, one was done for up to 300 units and <br />capacity was accommodated on that previously, but that was before the project became age -restricted, so <br />that information is provided for context only. In response to questions from the City Commission, Tim <br />Haskins with United Group, the developer on the project, clarified the requirements related to the age <br />restrictions for the community, stating that the typical age restricted definition was that the primary or one <br />of the residents have to be 55 years or greater. He noted that his company's developments are usually <br />further restricted to make it clear that no children under the age of 18 can reside on the property unless they <br />were needed to assist with the parents' care. A surviving spouse who is under the age of 55 would be <br />allowed to stay on the property. Under the Fair Housing Laws, it is typically stated that up to 20% can be <br />under that age, but deed restrictions on the property are utilized to keep the 55 plus requirements in place. <br />Ms. Reischmann noted that the PUD Agreement itself provides for all units to occupied or held available <br />for households that include one or more above the age of 55. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 24-1601 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1601. Mayor Henson opened the floor for public participation. No one <br />carne forward to address Ordinance 24-1601. Mayor Henson closed the public hearing relative to <br />Ordinance 24-1601. <br />MOTION: Commissioner Busch moved to adopt Ordinance 24-1601 on second and final <br />reading, as presented. Motion was seconded by Vice Mayor Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />B.
