Motion was seconded by Commissioner Busch. Motion carried <br />unanimously by voice vote 5-0. <br />11. PUBLIC HEARINGS <br />A. Public Hearing: Second Reading of Ordinance 24-1601- Amending the City's <br />Official Zoning Map Designation for One (1) Parcel Located at 1398 S.R. 436 <br />(Parcel ID 28-21-30-300-054B) and Approving the Associated Planned Unit <br />Development (PUD) Agreement and Concept Plan <br />The City Clerk read Ordinance 24-1601 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY'S <br />OFFICIAL ZONING MAP FROM CG (COMMERCIAL GENERAL) TO PMX-HIGH (PLANNED <br />MIXED-USE: HIGH RISE) FOR ONE PARCEL LOCATED AT 1398 S.R. 436, TOTALING <br />APPROXIMATELY 3.94 ACRES, AS DESCRIBED IN SECTION I OF THIS ORDINANCE, AND <br />APPROVING AN ASSOCIATED PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT AND <br />CONCEPT PLAN; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1601 <br />was advertised in the Orlando Sentinel on Friday, May 31, 2024. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.041(4), Florida Statutes. <br />Staff Presentation: Chief Planner Antonia De.lesus stated that Ordinance 24-1601 amends the Official <br />Zoning Map Designation for one (1) parcel located at 1398 S.R. 436 (Parcel ID 28-21-30-300-054B-0000) <br />from CG (Commercial General) to PMX-HIGH (Planned Mixed -Use: High Rise) and approves a Planned <br />Unit Development (PUD) Agreement and Concept Plan for an age -restricted apartment complex on the <br />subject property. The subject property consists of approximately 3.94 acres, has a Major Thoroughfare <br />Mixed -Use (MTMU) Future Land Use (FLUM) designation, and is currently zoned CG (Commercial <br />General). According to the City's Comprehensive Plan, the CG zoning district is inconsistent with the <br />MTMU Future Land Use designation, so in order to proceed with the development of a five -story age - <br />restricted (55+) apartment complex, the applicant is requesting that the City's Official Zoning Map <br />designation for the property be amended to PMX-HIGH, which is consistent with the current FLUM <br />designation.
