CASSELBERRY CITY CONIMISSION <br />Minutes of April 8, 2024 — Regular Mecting <br />Page 8 of 11 <br />Discussion: Discussion ensued which included the definition of "continuous sound", questions about how <br />other cities defined that term, and concerns that the proposed definition citing a one -second duration may <br />be too restrictive; the fact that the proposed ordinance was drafted using language from the current <br />Seminole County ordinance and also from the most recently adopted ordinances of other cities in Seminole <br />County; differences in restrictions on sound levels during daytime and nighttime hours; timelines and <br />distances related to proposed noise restrictions; clarification related to restrictions on amplified sounds; and <br />the rationale for the addition of "noise control officers" rather than enforcement being handled by the police <br />as it had been historically. Community Development Director Chris Schmidt clarified that the police would <br />still be used for mostly after hours calls on a non -emergency basis, but for calls during the daytime, utilizing <br />Code officers to respond, as well, would give more flexibility for response to calls rather than strictly relying <br />on the police. Additional discussion ensued regarding additional concerns about the continuous sound <br />definition potentially being too restrictive and situations where the yard maintenance exemptions may not <br />apply. Ms. Reischmann advised that before second reading of the ordinance, she would look at the concerns <br />brought up relating to continuous sound to see if adjustments to the definition should be made; the <br />restrictions on daytime noise, to see if the proposed restrictions were more or less restrictive than the <br />surrounding cities; and whether the language relating to proposed exemptions should be broadened. Mr. <br />Newlon suggested that as the Commissioners further reviewed the proposed ordinance before second <br />reading, they should let him know if they had any suggestions for changes or any specific concerns, and lie <br />would share those with staff so they could have information available to address those concerns at second <br />reading. <br />Budget Impact: There is no impact on the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 24-1599 on first reading. <br />Audience Participation: No one came forward to address Ordinance 24-1599. <br />MOTION: Commissioner Divita moved to approve Ordinance 24-1599 on first reading, <br />as presented. Motion was seconded by Commissioner Busch. Motion carried <br />by voice vote 4-1, with Commissioner Albritton dissenting. <br />B. First Reading of Ordinance 24-1600 — Amending the Future Land Use Map Designation <br />for Property Located at 2075 Howell Branch Road (Parcel ID 28-21-30-300-0280-0000) <br />The City Clerk read Ordinance 24-1600 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE <br />FUTURE LAND USE DESIGNATION FROM SEMINOLE COUNTY OFFICE TO <br />CASSELBERRY COMMERCIAL FOR ONE PARCEL LOCATED AT 2075 HOWELL BRANCH <br />ROAD, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICSTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />
