Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 23-1589. Mayor Henson closed the public hearing relative to <br />Ordinance 23-1589. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 23-1589 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Busch. <br />Motion carried unanimously by voice vote 4-0. <br />D. Second Reading of Ordinance 23-1590 — Charter Amendments <br />The City Clerk read Ordinance 23-1590 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, SUBMITTING TO THE <br />ELECTORS OF CASSELBERRY PROPOSED AMENDMENTS TO THE CHARTER OF THE <br />CITY OF CASSELBERRY AT THE REGULAR CITY ELECTION TO BE HELD AUGUST 20, <br />2024; PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE PROPOSED <br />CHARTER AMENDMENTS; PROVIDING FOR THE CALL OF A REFERENDUM ELECTION; <br />PROVIDING FOR DIRECTION TO THE CITY CLERK; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, CODIFICATION, EFFECTIVE DATE OF ORDINANCE AND AN <br />EFFECTIVE DATE FOR THE APPROVED AMENDMENTS." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 23-1590 <br />was advertised in the Orlando Sentinel on Thursday, November 30, 2023. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.041(4), Florida Statutes. <br />Staff Presentation: City Clerk Donna Gardner advised that with the assistance of the City Attorney and <br />the Charter Review Advisory Committee, the Charter review process which is required by the Charter every <br />eight years had been completed in a very short timeframe, taking only one month whereas in the past it had <br />been a four -to -six-month process. She stated that the Charter Review Advisory Committee's Final Report <br />had been accepted by the Commission on October 24, 2023. The Commission gave direction for some <br />revisions of the recommended questions and titles at the October 24, 2023 meeting and gave additional <br />direction at a Workshop held on October 31, 2023 for the City Attorney to prepare the appropriate ordinance <br />in accordance with State law. Ordinance 23-1590 was approved by the City Commission on first reading <br />at its regular meeting on November 27, 2023 by a 4-0 vote. The ordinance provides for eight (8) proposed <br />amendments to the City Charter to be placed on the August 20, 2024 City Election ballot. <br />Ms. Gardner gave a brief summary of the proposed amendments, which include: an extension of term limits <br />for the Commissioners from the current three (3) terms to five (5) terms; having all Commissioners seated <br />at one time at the December meeting following an election; changing the election timing from August to <br />November; eliminating the runoff election provision; removing the requirement for the City Manager's <br />City residency; providing for a super majority vote to remove the City Manager; removing the City <br />Manager's right to a hearing upon termination; and a housekeeping question to remove the reference to <br />Mayor/Commissioner and Vice Mayor/Commissioner and change those references to Mayor and Vice <br />Mayor only, and to clean up a glitch in the numbering on the Charter from the old numbering system in the <br />
