Ms. Gardner then stated that both she and City Attorney Reischmann were available <br />for questions should the Commission have any. Commissioner Meadows expressed thanks to all the <br />Charter Review Advisory Committee members for their time and contributions to the Charter review <br />process. He also extended his appreciation to City Clerk Gardner and City Attorney Reischmann for <br />spearheading the process and enabling the Committee to get it completed so quickly and efficiently. <br />Budget Impact: This item has no additional budget impact at this time. All related election expenses for <br />required advertisements and ballot question translation have been anticipated and budgeted accordingly in <br />various line items in the Commission's and Non -Departmental budgets. <br />Recommendation: The City Manager, the City Attorney, and the City Clerk recommended adoption of <br />Ordinance 23-1590 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to bear and consider comments and <br />questions regarding Ordinance 23-1590. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 23-1590. Mayor Henson closed the public bearing relative to <br />Ordinance 23-1590. <br />MOTION: Vice Mayor Busch moved to adopt Ordinance 23-1590 on second and final <br />reading, as presented. Motion was seconded by Commissioner Meadows. <br />Motion carried unanimously by voice vote 4-0. <br />Ms. Gardner advised that once the time got closer to the election in the new year, there would be some <br />Town Hall meetings scheduled for various dates in order to provide an overview of the amendments for <br />interested citizens. <br />12. OTHER ITEMS <br />A. Amendment No. 1 to Supplemental Agreement No. 5 with Wharton -Smith, Inc. <br />for a Guaranteed Maximum Price to Construct Wirz Park and Related Budget <br />Amendment #24-01 <br />Staff Presentation: Special Projects Manager Martin Butcher stated that approval of Amendment No. 1 <br />to Supplemental Agreement No. 5 to the Contractual Agreement with Wharton -Smith, Inc. for Construction <br />Manager at Risk (CMAR) for Parks Construction Projects for a Guaranteed Maximum Price (GMP), in the <br />amount of $7,861,772, to construct project PW 2109 Wirz Park Improvements and related Budget <br />Amendment 424-018 is requested (Ref. SOQ-2021-0715). Wharton Smith, Inc. has assembled a <br />Guaranteed Maximum Price (GMP) proposal in the amount of $7,861,771, as reflected in Amendment No. <br />1 to Supplemental Agreement No. 5. This GMP is the result of a competitive bidding process among <br />subcontractors for various trades associated with the project. The GMP also provides for Owner Direct <br />Purchases (ODP), which will yield sales tax savings, and a 5% contingency ($360,025) to cover <br />unanticipated additional work if needed. Budget Amendment #24-018 is necessary to provide sufficient <br />funding for the GMP and additional funding in the amount of $319,695 to cover City direct purchases <br />outside of the Owner Direct Purchases, for a total budget of $8,181,467.
