CASSELBERRY CITY COMMISSION <br />Minutes of December 11, 2023 — Regular Meeting <br />Page 15 of 30 <br />The City Clerk read Ordinance 23-1589 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO THE <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, FOR ONE <br />(1) PARCEL APPROXIMATELY 0.82 ACRES AND DESCRIBED WITH PARCEL <br />IDENTIFICATION NUMBER 33-21-30-300-007B-0000; REDEFINING THE CORPORATE <br />LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM <br />PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT EFFECTIVE IN <br />ACCORDANCE WITH LAW, THE PROPERTY TO BE ANNEXED SHALL BE ASSESSED FOR <br />PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE <br />COPIES OF THE ORDINANCE WITH THE SEMINOLE COUNTY CLERK OF THE CIRCUIT <br />COURT, THE CHIEF ADMINISTRATIVE OFFICER OF SEMINOLE COUNTY, AND THE <br />FLORIDA DEPARTMENT OF STATE; AND PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 23-1589 <br />was advertised in the Orlando Sentinel for two (2) consecutive weeks on Thursday, November 23, 2023 <br />and Thursday, November 30, 2023. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.04 ] (4), Florida Statutes. <br />Staff Presentation: Planner Matthew Linder gave an overview of Ordinance 23-1589 which annexes to <br />and includes within the corporate limits of the City of Casselberry one (1) property located approximately <br />525 feet south of the intersection of Howell Branch Road and State Road 436, Parcel Identification Number <br />33-21-30-300-007B-0000, comprised of approximately 0.82 acres. The subject property is presently <br />unincorporated and under the jurisdiction of Seminole County with a Commercial (C) Future Land Use <br />Map (FLUM) designation and C-1 (Retail Commercial) zoning designation. The property proposed for <br />annexation is contiguous to the municipal boundary; is well-defined and is a reasonably compact area; is <br />not included within the boundary of any other municipality; and does not create a pocket or enclave as <br />defined by Section 171.031 (13) of the Florida Statutes. Notice of tine City's intent to annex was provided <br />to Seminole County on November 8, 2023, and via certified mail on November 13, 2023, in accordance <br />with Florida Statutes Section 171.044 relating to voluntary annexation. After adoption, the City Clerk will <br />notify the Seminole County Clerk of the Circuit Court, the Chief Administrative Officer of the County, and <br />the Department of State within seven (7) days of the adoption. Once tine subject property is annexed into <br />the City, it will be provided a City future land use and zoning designation similar to the adjacent properties. <br />The applicant's intent is to apply for a Future Land Use Map Designation of Major Thoroughfare Mixed- <br />use (MTMU) and a Zoning Designation of PMX-MID (Planned Mixed -Use: Medium Rise) to support their <br />plans for a future multi -family development. <br />Budget Impact: There is no anticipated immediate impact on the City Budget. However, the property is <br />privately owned and is subject to taxation. As a result, tax revenue will be generated over time. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 23-1589 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />
