CASSELBERRY CITY COMMISSION <br />Minutes of December 11, 2023— Regular Meeting <br />Page la of 30 <br />MULTIFAMILY DESIGN STANDARDS; AMENDING SECTION 5-21.2 OF THE CITY'S <br />UNIFIED LAND DEVELOPMENT REGULATIONS TO PROVIDE DEFINITIONS OF TERMS, <br />INCLUDING "ADMINISTRATIVELY APPROVED," "COMMERCIAL," "DESIGNATES," <br />"MIXED USE RESIDENTIAL," "MIXED USE ZONING" AND "ZONED," AS USED IN FLA. <br />STAT. 166.04151 (2023), AND OTHER RELATED TERMS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 23-1586 <br />was advertised in the Orlando Sentinel on Thursday, November 30, 2023. <br />Business Impact Statement: This ordinance is exempt from the requirement for a Business Impact <br />Statement as provided in accordance with Section 166.041(4), Florida Statutes. <br />Staff Presentation: Chief Planner Antonia DeJesus stated that approval of Ordinance 23-1586 amending <br />the City's Unified Land Development Regulations (ULDR) of the City's Code of Ordinances to provide <br />standards for multifamily development and address the Live Local Act (Act) adopted in the 2023 <br />Legislative Session amending Florida Statutes Section 166.04151 is requested. The proposed ordinance <br />contains three distinct amendments to the City's Unified Land Development Regulations. The first <br />addresses affordable housing under the Live Local Act to address those changes in the Statute and refers to <br />the applicability of such regulations and provides basic development standards pursuant to the new statute. <br />It also speaks to the eligibility for administrative review and site plan approval, as well as the affordability <br />coin initment through restrictive covenant. The second section provides for multifamily design standards <br />which would be applicable to all multifamily developments, but also contains sections that speak directly <br />to those qualifying minimum living standards such as providing size and dimension criteria not currently <br />provided in the City's current land use table in the industrial zoning district, as well as providing for <br />architectural controls. The third section is to make sure the City's glossary conforms to current definitions <br />outlined in Florida Statutes. Additionally, the proposed amendments are consistent with specific goals, <br />objectives and policies outlined in the City's Comprehensive Plan. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 23-1586 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 23-1586. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 23-1586. Mayor Henson closed the public hearing relative to <br />Ordinance 23-1586. <br />MOTION: Vice Mayor Busch moved to adopt Ordinance 23-1586 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 4-0. <br />C.
