CASSELBERRY CITY COMMISSION <br />Minutes of December 11, 2023 — Regular Meeting <br />Page 13 of 30 <br />1 (Agriculture) zoning designation. The property proposed for annexation is contiguous to the municipal <br />boundary; is well-defined and is a reasonably compact area; is not included within the boundary of any <br />other municipality; and does not create a pocket or enclave as defined by Section 171.031(13) of the Florida <br />Statutes. Notice of the City's intent to annex was provided to Seminole County oil June 2, 2023, in <br />accordance with Florida Statutes Section 171.044 relating to voluntary annexation. Seminole County was <br />notified via certified mail on November 13, 2023 of the scheduled second reading and public hearing for <br />Ordinance 23-1585. After adoption, the City Clerk will notify the Seminole County Clerk of the Circuit <br />Court, the Chief Administrative Officer of the County, and the Department of State within seven (7) days <br />of the adoption. Once the subject property is annexed into the City, it will be provided a City future land <br />use and zoning designation similar to the adjacent properties. The applicants' intent is to apply for a Future <br />Land Use Map Designation of Medium Density Residential (MDR) and a Zoning Designation of RMF -13 <br />(Medium Density Multifamily) to support their plans for a future multi -family development. <br />Budget Impact: There is no anticipated immediate impact on the City Budget. However, the subject <br />property is privately owned and is subject to taxation. As a result, tax revenue will be generated over time. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 23-1585 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 23-1585. Mayor Henson opened the floor for public participation. The <br />following individual came forward: <br />1. Bob Ziegenfilss, 1201 East Robinson Street, Orlando, stated lie was the engineer for the project <br />and was present at the meeting representing the property owner and was available for any <br />questions the City Commission may have. <br />No one else came forward to address Ordinance 23-1585. Mayor Henson closed the public hearing relative <br />to Ordinance 23-1585. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 23-1585 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Busch. <br />Motion carried unanimously by voice vote 4-0. <br />B. Public Hearing: Second Reading of Ordinance 23-1586 — Amending the City's <br />Unified Land Development Regulations to Provide Standards for Multifamily <br />Developments and to Address the 2023 Live Local Act (LPA 23-02) <br />The City Clerk read Ordinance 23-1586 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY'S <br />UNIFIED LAND DEVELOPMENT REGULATIONS TO ADD SECTION 2-5.5, AFFORDABLE <br />HOUSING, TO REQUIRE A RESTRICTIVE COVENANT TO BE IMPOSED ON AFFORDABLE <br />HOUSING DEVELOPMENTS, AND PROVIDING A TIMELINE FOR CONSTRUCTION; <br />PROVIDING STANDARDS FOR MULTIFAMILY DEVELOPMENT BY AMENDING THE <br />CITY'S UNIFIED LAND DEVELOPMENT REGULATIONS TO ADD SECTION 3-10.14, <br />
