Mr. Hall advised that all the trash <br />and tents remain on the property. At the October 19, 2023, hearing the Respondents were given until <br />November 02, 2023, to achieve compliance or a $250.00 per day fine would be imposed. As of November <br />02, 2023, the property remained in violation, the fine of $250.00 per day should be imposed as of November <br />02, 2023, and run until compliance has been achieved. The Special Magistrate asked if there was anyone in <br />the audience that wished to speak about this case. There was no one present. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23-001512, located <br />at Parcel Number 09-21-30-5BM-OA00-OOP3 based on Code Officer testimony, the Respondents did not <br />comply by the Order imposed on October 19, 2023. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $250.00 per day for each day the violation exists and each day the <br />violations continues to exist past the date of compliance of November 02, 2023. If the Respondent brings <br />the property into compliance, the burden shall rest upon the Respondents to immediately notify the Code <br />Compliance Officer. <br />10. CE -23-001250: New Case at 5030 S U.S. HWY 17-92 Violation — City Code 3-16.11 Sign <br />maintenance. <br />Staff Presentation: Tyler Hall Code Compliance Officer gave testimony for case CE -23-001250, located <br />at 5030 S. U.S Highway 17/92. The property was reinspected and found to remain in violation on November <br />13, 2023. The City requested a correction date of December 16, 2023. If there is no compliance by <br />December 16, 2023, then a fine of $150.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requested a subsequent hearing date of January 18, 2024, to determine compliance. The <br />Special Magistrate asked if there was anyone present to speak about this case. The property owner was <br />present. <br />Discussion: Tedy Narvaez, 5030 S US HWY 17/92, advised that he had been in contact with Morgan, at <br />International Signs and Lighting. Two weeks ago, Mr. Narvaez was told it would be at least six weeks <br />before the sign could be completed. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23-001250, located <br />at 5030 S U.S. HWY 17/92 was in violation of the City Code Section as listed on the Notice of Code <br />Violation, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the Respondent shall cure the violation by 1:00 P.M. December 16, 2023. If there is no compliance by <br />December 16, 2023, then a fine of $150.00 per day will be imposed for each day the property remains in <br />non-compliance. A subsequent hearing will be held on January 18, 2024, to determine if compliance has <br />been achieved. <br />11. CE -23-001253: New Case at E 436 Parcel 21-21-30-300-004F-0000 Violation — City Code 3- <br />16.11 Sign maintenance. <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -23-001253, located <br />at E 436, parcel 21-21-30-300-004F-0000.
