The Special Magistrate asked if there was anyone present to speak about <br />this case, a property representative was present. <br />Discussion: Steve Jenkins, construction manager for H Z Donuts Inc., doing business as Dunkin Donuts <br />gave testimony. Mr. Jenkins apologized for the delay in getting the sign fixed. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-001253, located at E 436 21-21-30- <br />300-004F-0000 was in violation of the City Code Section as listed on the Notice of Code Violation, based <br />on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the Respondents <br />shall cure the violation by 1:00 P.M. December 16, 2023. If there is no compliance by December 16, 2023, <br />then a fine of $150.00 per day will be imposed for each day the property remains in non-compliance. A <br />subsequent hearing will be held on January 18, 2024, to determine if compliance has been achieved. <br />12. CE -23-002028: New Case at 860 Wolf Trail Violation — City Code 3-10.9.c. La Recreational <br />equipment )utility trailers, RV, camper, ATV, etc. <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that case CE -23-002028, <br />located at 860 Wolf Trail was in compliance. No further action was taken. <br />13. CE -23-002543: New Case at 1375 Lake Drive Violation — City Code 3-10.3.c.I 1 Overgrowth, <br />weeds, trash, and debris. <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -23-002543, located <br />at 1375 Lake Drive. The property was reinspected and found to remain in violation on November 13, 2023. <br />The City requested a correction date of November 30, 2023. If there is no compliance by November 30, <br />2023, then a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requested a subsequent hearing date of January 18, 2024, to determine compliance.
