Code Enforcement Hearing <br />Minutes, November 16, 2023 <br />Page 2 <br />Micelania Acevedo, Code Compliance Supervisor advised that all events occurred within the <br />corporate limits of the City of Casselberry. The Officer's notes, case narratives, testimony, photographs, <br />supporting documents and PowerPoint presentation were all entered as part of the official record. Ms. <br />Acevedo advised that the December 21, 2023, hearing will be cancelled, and the next hearing will be held <br />on January 18, 2024. <br />7. CE -23-000342: Subsequent Case at 101 NE Triplet Drive Violations — City Code 1-4.3 No building <br />permit, ULDR 2-5.3 Piers, boat slips and docks (non-commercial). <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that CE -23-000342, a <br />subsequent case located at 101 NE Triplet Drive was not in compliance. Ms. Acevedo advised that at the <br />August 17, 2023, hearing the Respondent was given until November 13, 2023, to achieve compliance or a <br />$150.00 per day fine would be imposed, as of November 13, 2023, the property remained in violation. The <br />fine of $150.00 per day should be imposed as of November 13, 2023, and run until compliance is achieved. <br />Permits have been obtained but there have been no final inspections. The Special Magistrate asked if there <br />was anyone present to speak about this case. There was a representative present. <br />Discussion: Ahmad Mohammed, 1850 W Lake Brantley Road advised that during the last hearing he began <br />applying for permits and it took about a month and a half to get approved. Permits were approved and <br />construction started the day permits were received. The Special Magistrate asked if Mr. Mohammed was <br />aware that once the property is in compliance, it is his obligation to reach out to Code Enforcement. Mr. <br />Mohammed stated yes and asked if he could get three more months. The special Magistrate asked if there <br />was anyone else who wished to speak about this case. There was no one present. <br />The Special Magistrate asked what the City's position was on extra titne. Ms. Acevedo advised that the <br />City wanted to proceed with the fines. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23-000342, located <br />at 101 NE Triplet Drive based on Code Officer testimony, the Respondents did not comply by the Order <br />imposed on August 17, 2023. It was ordered that the Respondents pay the City of Casselberry a fine in the <br />amount of $150.00 per day for each day the violations exist and each day the violations continue to exist <br />past the date of compliance of November 13, 2023. If the Respondent brings the property into compliance, <br />the burden shall rest upon the Respondents to immediately notify the Code Compliance Officer. <br />8. CE -23-001106: Subsequent Case at 671 Crestview Drive Violation — City Code 3-10.9.c.l.a <br />Recreational equipment (utility trailers, RV, camper, atv, etc.). <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that case 23-001106, <br />located at 671 Crestview Drive was in compliance. No further action was -taken. <br />9. CE -23-001512: Subsequent Case at Parcel number 09-21-30-5BM-OA00-OOP3 Violations — City <br />Code 2-7.9.a.7.a.1 Temporary structures, City Code 3-10.3.c.1 Overgrowth, weeds, trash and debris, <br />City Code 3-10.3.c.5.a Outdoor/open air storage — Unimproved land. <br />Staff Presentation: Tyler Hall, Code Compliance Officer advised that the City has been in contact with <br />the owner who just recently received the notices. The City is working with the Police Department to trespass <br />
