Mr. Campbell advised that the City's position was to support up to 90 days, the concern is that this is an occupied unit. <br />The Special Magistrate asked if there was an invitation for the tenant to leave the unit. <br />Mr. Walker stated yes. <br />Finding of fact: The Special Magistrate made a finding in CE -19-000258 873 E 436 SR #89, there was evidence of a <br />violation. A fine in the amount of $250.00 per day will be imposed if the violations are not corrected within 90 days (August <br />7, 2019). A subsequent hearing will be held on August 8, 2019 to determine compliance. The property was found to be in violation on November 13, 2018. The City <br />requests a correction date of June 8, 2019. If no compliance by June 8, 2019, then a fine of $50.00 per day should then be <br />imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of June 13, 2019 to <br />determine compliance. Mr. Eastwood described photos. <br />The Special Magistrate asked if Mr. Eastwood had spoken with the property owner and if so did they give a reason as to <br />why the roof has not been fixed. <br />Mr. Eastwood advised the roof damage was from the hurricane last year. The property owner does have a contract with a <br />Contractor and a permit is pulled. <br />Jonathan Radewicz, property owners son gave testimony and presented two documents, a copy of the contract with One Pro <br />Roofing and a copy of the initial check paid on December 11, 2018. <br />The Special Magistrate marked the documents as exhibits A and B. <br />Mr. Radewicz advised that the roof was not done because they did not get around to it, the rooking company was very busy <br />with a bunch of contracts in the panhandle, and this is why they have been bumped further and further down the list. Mr. <br />Radewicz continued. <br />Mr. Radewicz advised that the roofing company has been notified that is work does not start in a timely manner, they will <br />be fired and a new roofer will be found. <br />The Special Magistrate asked if there was anything further from Mr. Eastwood. <br />Mr. Eastwood stated no. <br />Finding of fact: The Special Magistrate made a finding in CE -18-003076 1041 Wingo Dr, there was found in violation, a <br />fine of $50.00 per day was imposed if no compliance June 8, 2019 and will not start to run for 30 days. If the roof is done <br />there will be no fine.
