Public Hearing: Resolution 23-3369 — Street Lighting Assessment Annual Rate <br />Resolution <br />The City Clerk read Resolution 23-3369 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, RELATING TO THE DELIVERY AND FUNDING OF STREET LIGHTING <br />SERVICES WITHIN THE CITY; APPROVING THE STREET LIGHTING ASSESSMENTS AND <br />STREET LIGHTING ASSESSMENT ROLL FOR FISCAL YEAR 2023-24; DETERMINING <br />THAT CERTAIN REAL PROPERTY IS SPECIALLY BENEFITED BY STREET LIGHTING <br />SERVICES; RATIFYING AND CONFIRMING THE PRELIMINARY RATE RESOLUTION; <br />PROVIDING THE METHOD OF COLLECTION; AND PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 23-3369 was advertised in <br />the Orlando Sentinel on Thursday, August 3, 2023. <br />Staff Presentation: Public Works & Utilities Director Kelly Brock stated that Resolution 23-3369 is the <br />Annual Rate Resolution for the implementation of the Street Lighting Assessment for Fiscal Year 2023- <br />2024. The rate is $42.86 per equivalent residential unit (ERU), an increase from the $31.88 per ERU <br />assessed for FY 2022-23. He introduced Chris Rowe, Special Counsel with Bryant Miller Olive, the City's <br />consultant which had been engaged to update the assessment methodology and rates, and City Engineer <br />Jane Dai who managed the update to the street light fees on behalf of the City. He noted that the City's <br />other subconsultant, Mike Burton, was unable to attend the meeting as he was in Jacksonville preparing for <br />potential storm impacts to the area. Dr. Brock then gave a brief overview of the item which included the <br />needs study and prioritization of improvements, and the City Commission's consensus to achieve Tier 2.5 <br />which would include completion of the first two tiers of improvements and approximately half of the third <br />tier of lower priority improvements. The net estimated revenue for this assessment factoring in government <br />contribution, as well, is $520,000 based on the proposed rates, which include raising the fee from the current <br />$31.88 per ERU (equivalent residential units) to $42.86 per ERU in order to be able to fund significant <br />capital improvements and ongoing maintenance. In addition to the Public Hearing Notice that was <br />advertised in the Orlando Sentinel, notices were mailed to all property owners that were affected based on <br />data received from the Seminole County Property Appraiser. Staff addressed feedback that had been <br />received in response to the notices, which consisted of approximately forty phone calls and one letter of <br />objection which was being researched to ensure there were no calculation errors in that case. In response <br />to questions, Dr. Brock stated he believed the way the increase was indexed meant that $54.71 was the <br />maximum that could it go in the future without additional noticing, and the idea was that it would ramp up <br />over ten years to deal with inflation and spreading out of the improvements. <br />
