FIRST READING OF ORDINANCES <br />A. First Reading; of Ordinance 23-1585 — Voluntary Annexation of Parcel 26-20-30-5AR- <br />OD00-055B (ANX 23-01) <br />The City Clerk read Ordinance 23-1585 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, ONE (1) <br />PARCEL APPROXIMATELY 4.85 ACRES DESCRIBED WITH PARCEL IDENTIFICATION <br />NUMBER 26-20-30-5AR-ODOO-055B; REDEFINING THE CORPORATE LIMITS OF THE CITY <br />OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND <br />DEVELOPMENT REGULATIONS; PROVIDING THAT EFFECTIVE IN ACCORDANCE WITH <br />LAW, THE PROPERTY TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF <br />MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE COPIES OF <br />THE ORDINANCE WITH THE SEMINOLE COUNTY CLERK OF THE CIRCUIT COURT, THE <br />CHIEF ADMINISTRATIVE OFFICER OF SEMINOLE COUNTY, AND THE FLORIDA <br />DEPARTMENT OF STATE; AND PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Staff Presentation: Planner Hunter McFerrin gave an overview of Ordinance 23-1585 which annexes to <br />and includes within the corporate limits of the City of Casselberry vacant property located to the east of an <br />unimproved right-of-way identified as David Drive, Parcel Identification Number 20-30-5AR-OD00-055B, <br />comprised of approximately 4.85 acres. The applicants and current owners of the subject property are <br />David Auerbach and Frances M. Pscuik-Auerbach with David Drive, LLC, and the subject property is <br />bordered by the City of Casselberry and the City of Winter Springs. Presently unincorporated and under <br />the jurisdiction of Seminole County, the subject property has inconsistent land entitlements with a Seminole <br />County Industrial Future Land Use Map (FLUM) designation and an A-1 (Agriculture) zoning designation. <br />The property proposed for annexation is contiguous to the municipal boundary; is well-defined and is a <br />reasonably compact area; is not included within the boundary of any other municipality; and does not create <br />a pocket or enclave as defined by Section 171.031(13) of the Florida Statutes. <br />
