Code Enforcement Hearing <br />Minutes, August 17, 2023 <br />Page 5 <br />10. CE -23-000303: Subsequent Case at 1541 Oak Lane Violation — City Code 2-7.10.a <br />Fence permit required. <br />Staff Presentation: Supervisor Acevedo advised that CE -22-000303, 1541 Oak Lane was in <br />compliance by the date previously set on July 20, 2023, and no fine should be imposed. There <br />was no further action taken. <br />11. CE -23-000322: Subsequent Case at 960 Belle Avenue Violation — City Code 3- <br />10.3.c.5.a Outdoor/open air storage — Unimproved land. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000322, 960 Belle Avenue was not <br />in compliance by the date previously set on July 20, 2023, by the Special Magistrate and the fine <br />should be imposed. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23- <br />000322, 960 Belle Avenue based on Code Officer testimony, the Respondents did not comply by <br />the order imposed on July 20, 2023. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $100 per day for each day the violation exists and each day <br />the violation continues to exist past the date of compliance of August 17, 2023. The burden shall <br />rest upon the respondents to immediately notify the Code Compliance officer. The Special <br />Magistrate asked if the Respondent(s) were present. There was no one present. <br />12. CE -23-000342: New Case at 101 NE Triplet Drive Violation — City Code 1-4.3 No <br />building permit, ULDR 2-5.3 Piers, boat slips and docks (non-commercial) <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on August 14, 2023. The City requested a correction date of <br />September 18, 2023. If no compliance by September 18, 2023, then a fine of $150.00 per day <br />should then be imposed for each day of non-compliance thereafter. The City requests a <br />subsequent hearing date of September 21, 2023, to determine compliance. The Special <br />Magistrate asked if there was anyone present to speak about this case, there was a representative <br />present to speak about this case. <br />Discussion: Ahmad Mohammed, 3451 Dawn Court, Lake Mary, FL came forward and <br />addressed the Special Magistrate. The property was purchased about three months ago, they did <br />some demo work, and the plans were recently received back from the architect. The plan will be <br />submitted to the City, and for the deck a demo permit will be submitted to remove the deck. Mr. <br />Mohammed asked the Special Magistrate if he could get sixty to ninety days since he just received <br />the plans. Mr. Andreone has no objection to giving an extension of time. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-000342, located at 101 NE <br />Triplet Drive was in violation of the City Code Sections as listed on the notice of code violation, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the respondent shall cure the violations by 1:00 P.M. November 13, 2023. If there is no compliance <br />by November 13, 2023, then a fine of $150.00 per day will be imposed for each day the property <br />remains in non-compliance. A subsequent hearing will be held on November 16, 2023, to <br />determine if compliance has been achieved. <br />
