Code Enforcement Hearing <br />Minutes, August 17, 2023 <br />Page 4 <br />Ms. Nix stated it was the City's position that aside from the specific code provisions that were <br />pulled from the notice of violation, the property remains in violation of the cited provisions of the <br />City Code. <br />Jay Calvert, 9056 Great Heron Circle, Orlando spoke in response to the stairs, there were two <br />that were inaccessible due to being taped up and are currently under active building permits. The <br />property owners are not aware of other stairs that are inaccessible other than the two that are <br />under construction. <br />Mr. Kovecses addressed the resident complaints made at the meeting and it highlighted that the <br />problems did not just arise in the last five months, since the Respondent purchased the property. <br />Mr. Kovecses continued and stated they were asking the Special Magistrate for more time. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-001033, located <br />at 1131 Castle Woods Terrace was in violation of the City Code Sections City Code 1-4.3.a: <br />No Building Permit, City Code 3-10.3.a.2 Buildings and accessory structure damage/graffiti, City Code 3- <br />10.3.a.4 Roofs, gutters, down spouts — maintenance, City Code 3-10.3.c.1: Overgrowth, weeds, trash and <br />debris, City Code 3-10.9.f Unlicensed and/or Inoperable Vehicles, City Code 1-4.1 Damaged Windows, <br />Skylights, Doors, Standard Unsafe Building Abatement Code (SUBAC) Unsafe Building - Section 1-4.6, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was <br />ordered that the respondent shall cure the violations by 1:00 P.M. September 18, 2023. <br />If there is no compliance by September 18, 2023, then a fine of $250.00 per day will be <br />imposed for each day the property remains in non-compliance. A subsequent hearing will <br />be held on September 21, 2023, to determine if compliance has been achieved. <br />8. CE -22-000345: Subsequent Case at 92 Mark David Boulevard Violations — City Code <br />1-4.3 No building permit. <br />Staff Presentation: Supervisor Acevedo advised that CE -22-000345, 92 Mark David Boulevard <br />was in compliance by the date previously set on July 20, 2023 and no fine should be imposed. <br />There was no further action taken. <br />9. CE -23-000285: Subsequent Case at Sunshadow Drive Violation — City Code 3- <br />10.3.2.1 Overgrowth, weeds, trash and debris. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000285, Sunshadow Drive was not <br />in compliance by the date previously set on July 20, 2023, by the Special Magistrate and the fine <br />should be imposed. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23- <br />000285, Sunshadow Drive based on Code Officer testimony, the Respondents did not comply by <br />the order imposed on July 20, 2023. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $150 per day for each day the violation exists and each day <br />the violation continues to exist past the date of compliance of August 17, 2023. The burden shall <br />rest upon the respondents to immediately notify the Code Compliance officer. The Special <br />Magistrate asked if the Respondent(s) were present. There was no one present. <br />
