SECTION II. ETHICS IN PUBLIC CONTRACTING <br />2.0STANDARDS OFCONDUCT <br />A.Public employment is a public trust. Public employees must discharge their duties <br />impartiallysoastoassurefair,competitiveaccesstoCityprocurementbyresponsible <br />contractors.Employees should conduct themselves in such amanner as to foster public <br />confidence in the integrity of the City’s procurementprocess. <br />B.The Procurement and Contract Management Division adheres and subscribes to the <br />National Institute of Governmental Purchasing, Inc. (NIGP) Code of Ethics,Florida <br />Association of Public Procurement Officials (FAPPO)and American Purchasing Society <br />(APS)asamended. <br />C.Fraudulent Misconduct.All employees of the City, officers, and elected officials under <br />the jurisdiction of the City, and anyone doing business for or with theCity, are prohibited <br />from placing City resources at risk through fraudulent misconduct, misappropriation of <br />assets, and fraudulent reporting of information affecting theCity. <br />D.Failure of a City employee to adhere to this Policy or the Procurement procedures as <br />establishedbytheCityManagershallsubjectthat employee to disciplinary action upto <br />and including termination. <br />E.Those doing business with the City must observe high standards of honesty and integrity. <br />Anyefforttoinfluenceanyemployeetobreachstandardsofethicalconduct is also a <br />breach of ethicalstandards. <br />2.1CONFLICT OFINTEREST <br />A.Conflict of Interest. Bidders, members of an Evaluation Committee, awarded <br />Contractors, and City employees shall not engage in any action that would createa <br />conflict of interest in the performance of their obligation with the City, or would <br />violate, or cause others to violate, the applicable provisions of the Florida Statutes and <br />federal laws relating to ethics ingovernment. <br />No procurement of goods, services, professional services or construction in which a <br />conflict of interest occurs between the City and the vendor shall be made with any <br />person. Aconflict of interest may occur under the following situations: <br />1.Gifts. Aperson or business entity doing business with the City is prohibited from <br />giving,eitherdirectlyorindirectly,agiftthathasavalueinexcessof$100 to <br />an employee of the City, City official, or the City’s Procurement and Contracts <br />Management Division or any other person on his or her behalf that reasonably tends to <br />influence or reward official conduct; or the person or business entity knows is intended <br />to reward the employee in the discharge of official duties, asoutlined in Section <br />112.3148, Florida Statutes, as amended. <br />2.An employee of the City or an individual chosen by the City to serve as a <br />member of an evaluation committee has amaterial interest in the vendor as <br />defined in the FloridaStatutes. <br />Page 8 <br /> <br />
