3.Amember of the City Commission, the City Manager, or a spouse, or child, has <br />an employment relationship or a material or financial interest in the vendor, as <br />defined in the FloridaStatutes. <br />4.As otherwise provided pursuant to FloridaStatutes. <br />B.No public officer or employee of the City shall solicit anything of value, including a <br />gift, loan, reward, promise of future employment, favor orservice. <br />C.In addition to the prohibitions concerning gifts and gratuities as stated in Sections <br />112.313(2) and 112.3148, Florida Statutes and the City Human Resource policies, <br />employees within the Procurement and Contract Management Division shall not <br />accept any gift from a Lobbyist, as that term is defined in Section 112.3148(2) (b), <br />Florida Statutes, regardless of the dollar value. City employees should refer to Human <br />Resources Employee Manual relating to regulations regardinggifts. <br />D.It shall be unethical for any payment, gratuity, or offer of employment to be made by, <br />or on behalf of, a potential bidder, contractor, or subcontractor, to any person <br />associated with a particular solicitation or award, as an inducement for the award. All <br />potential bidders, contractors and subcontractors are bound by the Cone of Silence <br />below. <br />E.Anyviolationofanyprovisionofthissectionshallsubjecttheviolatortothesanctions <br />containedintheFloridaStatutesChapter112andanyotherapplicablestateorfederal law, <br />as well as adverse employmentaction. <br />2.2CONE OF SILENCE <br />A.The Cone of Silence is a prohibition on communications relating to a competitive <br />solicitation or advertised solicitation which commences upon the issuance of the <br />solicitationdocument. <br />B.The Cone of Silence for awards requiring City Commission approval concludes at the <br />beginning of the meeting at which the City Commission will be presented the award(s) <br />forapprovalortorequestauthorizationtonegotiateacontract(s),orwhen the <br />Commission rejects all bids or responses to the sealed competitive solicitation, or takes <br />other action which ends the sealed competitive solicitation process. However, if the <br />City Commission refers the item back to the City Manager for further review, or <br />otherwise does not take action on the item, the Cone of Silence willbereinstateduntil <br />suchtimeastheCityCommissionmeetstoconsidertheitem foraction. <br />D.Bidders, respondents, lobbyists or consultants shall not contact any City employee or <br />City official, including the City Commission, the City Manager, or anymember of the <br />Evaluation Committee concerning an active Solicitation during the Cone of Silence <br />Period. All questions and inquiries concerning procedural matters shallbe directed to <br />the Procurement and Contract Management Division only. The contact person must <br />not be a member of the selection/evaluation committee or the person designated to <br />negotiate thecontract. <br />Page 9 <br /> <br />
