18.Legal Services. To include attorney, paralegals, expert witnesses, interpreters, <br />translation services, mediators, and courtreporters. <br />19.Material from publishers and copyrightholders. <br />20.Medicaid Services delivered to an eligible Medicaid recipient unless the <br />agency is directed otherwise bylaw. <br />21.Prevention Services related to mental health, including drug abuse prevention <br />programs, child abuse prevention programs, and shelters for runaways, <br />operated by not-for-profitcorporations. <br />22.Professional services. Contracts for professional services involving peculiar <br />skill, ability, experience or expertise, which are in their nature unique and not <br />subject to competitive bidding, or competitive proposals; however,statelaws, <br />suchastheConsultants’CompetitiveNegotiationAct, as amended, to the <br />extent applicable, shall befollowed. <br />23.Public Notices, except as regulated by Policy, Ordinance and/or Florida <br />Statutes asamended. <br />24.RealProperty,exceptasregulatedbyPolicy,OrdinanceandbindingFlorida <br />law, asamended. <br />25.Security related purchases. <br />26.Services or Commodities exempted by Florida Statutes, asamended. <br />27.Services or Commodities provided by Non-Profit organizations or other <br />governmentalentities. <br />28.Payments for goods or services which are Direct Payments as defined in this <br />Policy. <br />29.Sole Source goods or services that are only available through onesource. <br />30.Sponsorships. <br />31.Standardized Equipment Annual Maintenance repairs and supportcosts. <br />32.Utilities. <br />33.Workshop and seminar registration, attendance, training, strategicplanning <br />and/or costs of job-relatedtravel. <br />D.Best interest of the City. Purchases and contracts for commodities or services are <br />exemptfromcompetitiveselectionwhentheCityCommissiondeclaresthatthe <br />processof competitive bidding and/or competitive proposals is not in the best interest <br />of theCityunless the exemption is inconsistent with applicable Federal laws, State <br />statutes, or City code. <br />1.2SEVERABILITY <br />If any section of this Policy, or any application thereof, to any Person or circumstance is <br />held invalid, such invalidity shall not affect other sections or applications of this Policy, <br />which can be giveneffectwithouttheinvalidsectionorapplication,andtothisend,the <br />sectionsorapplications of this Policy are declared to beseverable. <br />1.3WAIVER OFREQUIREMENTS <br />The City Commission may, when deemed to be in the best interest of the City and not <br />inconsistent with applicable Federal laws, State statutesor City codes,waive any or all <br />requirements or provisions set forth in this Policy and proceed thereafter to take whatever <br />action is deemed to be in the best interest of the City. <br />Page 6 <br /> <br />
