2. Development Approval. The parties acknowledge that the amendments to the Legacy <br />Park Planned Development required to allow the development of the Project on the Pulte Property as <br />generally depicted on the conceptual plan attached hereto and incorporated herein as Exhibit `B" (the <br />"Concept Plan") have been approved by the City Commission, and have been found to be in accordance <br />with the City's Comprehensive Plan and Land Development Code in effect as of the date hereof. Pulte <br />recognizes this zoning approval does not vest Pulte for development in accordance with the Concept Plan. <br />3. Pulte Commitments. The conditions and commitments made as to this zoning approval, all <br />of which have been accepted by and agreed to by Pulte, are as follows: <br />A. A minimum of 50% of the lots in the Project will be 50' wide. <br />B. The Project is approved for up to 123 lots and homes. <br />C. The Project will be constructed generally in the configuration as shown on the Concept <br />Plan attached hereto as Exhibit B, subject to receiving final site plan approval from the <br />City. <br />D. Pulte commits to the floor plans and fagades attached hereto and incorporated herein as <br />Exhibit C. <br />E. At a minimum the Project will include the following amenities, to the extent consistent with <br />City Code, some of which are generally depicted on Exhibit "D" attached hereto and <br />incorporated herein, and all of which will be shown in greater detail on the site plan: <br />a. Gated landscaped entrance to include brick and cast stone with decorative <br />fencing. <br />b. Painted 6' precast walls and/or vinyl fence surrounding the south and east sides of <br />the community. <br />c. Mail kiosk area. <br />d. A miniumum 2,400 square foot fenced playground with surrounding benches. <br />e. A minimum 1,000 square foot pool with a minimum 3,850 square feet of <br />surrounding pool deck space with lounge chairs and tables. <br />f. A minimum 800 square foot open air cabana with a minimum 400 square foot <br />enclosed restroom area providing covered seating on the pool deck. <br />g.
