Wright, Esq. <br />Shutts & Bowen LLP <br />300 Orange Ave., Ste 1000 <br />Orlando, Florida 32801 <br />VOLUNTARY DEVELOPMENT COMMITMENT AGREEMENT <br />[FOR LEGACY PARK] <br />THIS VOLUNTARY DEVELOPMENT COMMITMENT AGREEMENT ("Agreement") is made this 1c,"' k <br />day of tie' u,-5 F , 2015, between PULTE HOME CORPORATION, a Michigan corporation, whose <br />address is 4901 Vineland Road, Suite 500, Orlando, FL 32811 ("Pulte"), and the CITY OF <br />CASSELBERRY, FLORIDA, a Florida municipality, whose address is 95 Triplet Lake Drive, Casselberry, <br />Florida 32707 (the "City"). <br />RECITALS <br />WHEREAS, The Geneva School, Inc. ("Owner") is the owner of that certain real property located in <br />Casselberry, Florida, more particularly identified with Parcel ID# 10-21-30-5RU-0000-0050 (the "Property"); <br />WHEREAS, Owner has entered into a purchase and sale agreement to sell the portion of the <br />Property more particularly described in Exhibit "A" attached hereto and incorporated herein by this <br />reference (the "Pulte Property") to Pulte; <br />WHEREAS, Pulte desires to develop the Pulte Property with up to 123 single family detached <br />homes and associated amenities, as are more particularly described below (the `Project"); <br />WHEREAS, the City is authorized to regulate the development of the Pulte Property; <br />P <br />WHEREAS, Pulte and City desire to set forth and memorialize certain conditions, development <br />standards and other obligations imposed by the City and other conditions applicable to the proposed <br />development of the Pulte Property at this rezoning stage. <br />NOW THEREFORE, in consideration of the above premises, the promises and provisions <br />contained herein and other good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the City and Pulte agree as follows: <br />1.
