Sidewalks interconnecting the landscaped park with the neighborhood's east <br />west walk, along with pad mounted benches and shade trees. <br />i. A miniumum 0.7 acres of community open space in the northeast corner of the <br />Project that will incorporate a dog park that provides an off -leash roaming area for <br />residents' dogs, and will include parking for the dog park. <br />j. Driveway pavers for each lot in the Project. <br />4. Non -Substantial Changes. Any non -substantial changes to the Concept Plan, the Pulte <br />commitments set forth in this Agreement, or other approvals may be approved by the City's Community <br />Development Director. In the event that the Community Development Director determines that the change <br />is substantial in nature, the change shall require the approval of the City Commission as an amendment to <br />this Agreement. <br />5. Comprehensive Plan and Land Development Regulations. The City expressly finds and <br />acknowledges that the development set forth in the Concept Plan and in this Agreement is consistent with <br />the City's Comprehensive Plan and is consistent with the City's Land Development Code. It is agreed that <br />the development of the Pulte Property should be subject to the provisions of the City's Comprehensive Plan <br />and the City's Land Development Code in effect as of the date of development. <br />6. Amendment. This Agreement may be amended or terminated only by a written instrument <br />executed by the parties hereto or by their respective successors in interest or assigns, and approved by the <br />City Commission after public hearing. <br />7. Recording. This Agreement shall be recorded by the City, at Pulte's expense, among the <br />Public Records of Seminole County, Florida within 10 days of its execution. The recordation of this <br />Agreement shall not constitute or impose any lien or encumbrance upon the title in the Pulte Property and <br />shall instead only constitute record notice of governmental regulations which govern the development and <br />use of the Pulte Property. <br />8. Severability. If any provisions of this Agreement are held to be illegal or invalid, the <br />remaining provisions of this Agreement shall remain in full force and effect. <br />9. Compliance. Pulte agrees that it, and its successors and assigns, will abide by the <br />provisions of this Agreement, the City's Comprehensive Plan, and the City's Land Development Code. <br />Further, all required improvements, including landscaping, shall be continuously maintained by Pulte, or its <br />successors and assigns, in accordance with the City's Land Development Code. <br />Page 3 <br />ORLDOCS 141591681 <br />
