Code Enforcement Hearing <br />Minutes, March 16, 2023 <br />Page 3 <br />9. CE -22-000564: New Case at 290 Iris Road Violation — City Code 3-10.3.c.5.b <br />Outdoor/openair storage — Commercial or Industrial, City Code 3-15.4.a Parking areas <br />used for purposed other than parking, City Code 3-15.4.d Paving of parking surface, <br />maintenance and construction specifications, City Code 3-15.6.d Accessibility parking <br />and passenger loading zones, City Code Disabled, inoperable, or abandoned <br />vehicle(s), City Code 82-131.c Unlawful disabled parking. <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on March 13, 2023. The City requested a correction date of April 17, <br />2023. If no compliance by April 17, 2023, then a fine of $150.00 per day should then be imposed <br />for each day of non-compliance thereafter. The City requests a subsequent hearing date of April <br />20, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to <br />speak to this case, the business owner was present. <br />Discussion: Tristan Sothern, business owner at 290 Iris Road came forward and addressed the <br />Special Magistrate. Antonia DeJesus, Planner II for the City of Casselberry, addressed the <br />Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -22-000564, located at 290 Iris <br />Road was in violation of the City Code Sections as listed on the notice of code violation, based <br />on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the <br />respondent shall cure the violations by 1:00 P.M. September 18, 2023. If there is no compliance <br />by September 18, 2023, then a fine of $150.00 per day will be imposed for each day the property <br />remains in non-compliance. A subsequent hearing will be held on September 21, 2023, to <br />determine if compliance has been achieved. <br />10. CE -22-000703: New Case at 460 Violet Dell Drive Violations — City Code 3-10.3.a.4 <br />Roofs, gutters, down spouts — maintenance. <br />Staff Presentation: Officer McDonald gave testimony that the property was reinspected and <br />found to remain in violation on March 13, 2023. The City requested a correction date of May 15, <br />2023. If no compliance by May 15, 2023, then a fine of $50.00 per day should then be imposed <br />for each day of non-compliance thereafter. The City requests a subsequent hearing date of May <br />18, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to <br />speak to this case, the property owner was present. <br />Discussion: Alluska Martineza, property owner at 460 Violet Dell Drive came forward and <br />addressed the Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -22-000703, located at 460 <br />Violet Dell Drive was in violation of the City Code Sections as listed on the notice of code violation, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the respondent shall cure the violations by 1:00 P.M. May 15, 2023. If there is no compliance by <br />May 15, 2023, then a fine of $50.00 per day will be imposed for each day the property remains in <br />non-compliance.
