Code Enforcement Hearing <br />Minutes, March 16, 2023 <br />Page 2 <br />5. Statement of Evidence <br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City. <br />The Officer's notes, case narratives, testimony, photographs, supporting documents and <br />PowerPoint presentation were all entered as part of the official record. <br />6. CE -22-000438: Subsequent Case at 427 Elm Drive Violation — City Code 1-4.3.a. No <br />Building permit. <br />Staff Presentation: Supervisor Acevedo advised that CE -22-000438, 427 Elm Drive was not in <br />compliance by the date previously set of January 16, 2023, by the Special Magistrate and the fine <br />should be imposed. Ms. Acevedo advised that the property owners were present. <br />Discussion: Mark and Brittany Gau, property owners of 427 Elm Drive came forward and <br />addressed the Special Magistrate. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22- <br />000438, 427 Elm Drive based on Code Officer testimony, the Respondents did not comply by <br />the order imposed on October 20, 2022. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $150 per day for each day the violation exists and each day <br />the violation continues to exist past the date of compliance of January 16, 2023. The burden <br />shall rest upon the respondents to immediately notify the Code Compliance officer. <br />7. CE -22-000907: Subsequent Case at 1500 Carlisle Drive Violations — City Code 3-10.3.c.1 <br />Overgrowth, weeds, trash, and debris, City code 3-10.9.c.1.a Recreational equipment, <br />City Code 3-10.9.f Unlicensed and/or inoperable vehicles. <br />Staff Presentation: Supervisor Acevedo advised that CE -22-000907, 1500 Carlisle Drive was <br />not in compliance by the date previously set of March 16, 2023, by the Special Magistrate and <br />the fine should be imposed. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22- <br />000907, 1500 Carlisle Drive based on Code Officer testimony, the Respondents did not comply <br />by the order imposed on February 16, 2023. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $100 per day for each day the violation exists and each day <br />the violation continues to exist past the date of compliance of March 16, 2023. The burden shall <br />rest upon the respondents to immediately notify the Code Compliance officer. <br />8. CE -23-000037: Subsequent Cast at 505 EI Dorado Way Violations — City Code 3-10.3.a.4 <br />Roofs, gutters, down spouts maintenance, City Code 3-10.3.b.2 Deteriorated or <br />damaged fence, City Code Outdoor/open air storage -residential, City Code 3-10.3.C.7 <br />Swimming pool standards, City Code 3-10.9.e.2.a.1 Residential designated parking. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000037, 505 EI Dorado Way was <br />in compliance by the date previously set of March 16, 2023, by the Special Magistrate and no fine <br />should be imposed. <br />
