Code Enforcement Hearing Minutes, March 16, 2023 Page 4 11. CE -22-000822: New Case at 3405 S US Hwy 17-92 Violations — City Code 3-10.c.3 Site maintenance obligation. Staff Presentation: Officer Andreone gave testimony that the property was reinspected and found to remain in violation on March 13, 2023. The City requested a correction date of April 17, 2023. If no compliance by April 17, 2023, then a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of April 20, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to speak to this case, there was no one present. Special Magistrate Ruling: The Special Magistrate found that CE -22-000822, located at 3405 S US Hwy 17-92 was in violation of the City Code Sections as listed on the notice of code violation, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. April 17, 2023. If there is no compliance by April 17, 2023, then a fine of $100.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing will be held on April 20, 2023, to determine if compliance has been achieved. 12. CE -22-000932: New Case at 370 Marigold Road Violations — City Code 3-10.3.a.4 Roofs, gutters, down spouts — maintenance. Staff Presentation: Officer McDonald gave testimony that the property was reinspected and found to remain in violation on March 13, 2023. The City requested a correction date of May 15, 2023. If no compliance by May 15, 2023, then a fine of $50.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of May 18, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to speak to this case, there was no one present. Special Magistrate Ruling: The Special Magistrate found that CE -22-000932, located at 370 Marigold Road was in violation of the City Code Sections as listed on the notice of code violation, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. May 15, 2023. Cases Withdrawn from Hearing CE -22-000717 1533 Seminola Blvd. CE -23-000004 1442 SR 436 Officer Acevedo advised the Special Magistrate that the above listed items were withdrawn from the March 16, 2023 hearing.
