City Council <br />December 18, 1989 <br />5. Required Improvements - Mr. Campbell said original <br />conditions of annexation, Section 3, stated that certain <br />improvements must be completed prior to site plan <br />approval, i.e., four-laning of Derbyshire Road and <br />Subsection E, dedication of buffer zone park to the <br />City. It has been suggested that Section 3 relating <br />to the four-laning of Derbyshire Road should be <br />amended to a three -lane situation with two outbound <br />lanes and one inbound at the Derbyshire Road/Lake <br />Howell intersection (shown on plans at present time) . <br />Four-laning of Derbyshire is not desirable at this <br />time. Subsection E, dedication of buffer zone park <br />to the City, should be amended to stated that the <br />applicant will be responsible for the maintenance of <br />this buffer zone in conjunction with the maintenance <br />of other areas on the south and west side of the <br />site which are adjacent to single-family homes. <br />Mr. Henson said he had no objections and would <br />maintain the buffer area. <br />6. Concurrency - Refer to wording on page 4 regarding <br />Concurrency. Mr. Hanson said he agreed and would <br />comply as stipulated. <br />7. Forest Brook Signage - Mr. Campbell said agreements <br />need to be reached regarding the signage and any <br />associated plantings to be maintained. Due to the <br />road widening and sidewalk improvements, Forest Brook <br />entrance sign will have to be moved and in order to <br />have the adequate visual clearance that is required by <br />Chapter 71 of the Code, this would place the sign on <br />City property or would become City property as a <br />result of the plat. It is requested that an agreement <br />be executed that provides that the homeowners associa- <br />tion will accept the responsibility for maintenance and <br />liability regarding the sign. <br />Ms. Betty Noise, Representative for the Forest Brook <br />Homeowners Association, said the association is presently <br />maintaining the sign/entrance way and would have no <br />problem signing an agreement for perpetual maintenance, <br />but she would have to go back to the Board of Directors <br />for a vote regarding liability with reference to the sign. <br />Relocation of the sign will be contingent upon the vote <br />of the Board of Directors. <br />Mr. Bob Stevens, Recreation Director, has indicated that <br />the relocation of the proposed sign is acceptable to the <br />Recreation Department, contingent upon the agreement for <br />maintenance and liability. <br />(15) <br />
