Facilities Maintenance - Mr. Campbell said suitable <br />restrictions relating to maintenance of facilities common <br />to all lots are needed due to the potential for different <br />owners. <br />Mr. McIntosh said this would be included in the <br />Declarations, Covenants, Conditions and Restrictions <br />under what is known as a Maintenance Covenant. <br />2. Sidewalks - Mr. Campbell said this item was covered <br />under the final plat. Also it is recommended that all <br />on-site sidewalks and jogging trails proposed widths <br />and construction materials be indicated; suitable ease- <br />ments need to be provided. <br />Mr. Hanson said he had no problem with granting <br />easements to the City for the jogging trail and would <br />so indicate on the drawings. <br />3. Flood Hazard/Drainage - Mr. Campbell said this item <br />was covered under the final plat. Also suitable pro- <br />visions concerning compensatory storage need to be <br />made to satisfy the City Engineer. Mr. Campbell said <br />the City Engineer has indicated he is satisfied. In <br />addition proposed elevations for off-site sidewalk im- <br />provements need to be indicated. <br />Mr. Hanson said he would comply. <br />4. Building Elevations/Floor Plan - Mr. Campbell said <br />that one -bedroom units must have a minimum floor <br />area of 800 square feet. There is concern as to <br />whether Unit E1 shown on Sheet 4 of 41 should be <br />considered an efficiency or a one -bedroom unit. <br />The Planning Department is of the opinion that this <br />unit should be shown as a one -bedroom due to its <br />design/configuration; the applicant feels it should <br />be shown as an efficiency unit. <br />Mr. Hanson said the Building Department has indi- <br />cated that this configuration did meet the requirements <br />of an efficiency, pursuant to Code. Mr. McIntosh said <br />any differences between City departments, i.e. Building <br />Department and the Planning Department, the ultimate <br />responsibility for definition rests with the Mayor. <br />Mayor Dennison defined the unit as an efficiency unit. <br />(14) <br />
