City Council <br />December 18, 1989 <br />with Sections 151.30 and 151.31, City Code, to minimize <br />the potential of flood hazards. Verification is needed <br />from the City Engineer prior to final plat approval re- <br />garding what elevation will be accepted insofar as the <br />100 year flood level. Mr. Campbell said since the <br />December 14, 1989 memo was submitted, Mr. Ehlers <br />has indicated he was satisfied with the various circum- <br />stances relating to the flood hazards and the flood <br />hazard ordinance. <br />3. Easements - Mr. Campbell said suitable cross easements <br />need to be approved, executed and recorded inconjunction <br />with the final plat. Written verification is needed from <br />the utility companies prior to final plat approval regarding <br />the suitability of the lots for the provision of utility ser- <br />vices. Also a cross access easement would be created by <br />revised declarations of covenants, conditions and restric- <br />tions recently submitted. <br />Mr. Cleatous J. Simmons, Attorney, Lowndes, Drosdick, <br />Doster, Kantor 4 Reed, representing the Applicant, <br />said as it relates to cross access easements between the <br />various parcels, only 2 parcels (4 and 5) are actually <br />being developed for residential purposes. There is no <br />way legally to grant an easement to yourself and as long <br />as both these parcels are owned by the same owner, <br />cross access easements cannot be created. He suggested <br />the Developers Agreement have a condition as part of <br />the approval, that if there is any division of ownership <br />in the future, at that time sufficient easements will be <br />recorded for cross access; also for required utility pur- <br />poses between the various parcels for offsite utility <br />companies to service the development. Mr. McIntosh said <br />he would have no problem with this commitment so long <br />as it is included in the Agreement that in the event the <br />parcels are divided into separate ownerships, a continuing <br />condition would be the availability of cross access easement <br />between the separated parcels. Council agreed. <br />4. Land Clearing Plan - Mr. Campbell said a suitable land <br />clearing plan is required prior to approval of the final <br />plat. Also needed is clarification of location of tree <br />cluster 5b and removal of reference to Note 1 on the plans. <br />Mr. Jack Hanson, Embrey Associates, said he would <br />comply. <br />(12) <br />
