Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />December 14, 2022 <br />Page 4 <br />provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the <br />written findings in the staff report. The conditions of approval are as follows: <br />Waiver: <br />1. A waiver request to permit 13 of the 39 parking spaces (39%) to be reduced -sized parking spaces at 9 ft. <br />by 18 ft. <br />2. A waiver request for a parking computation of 1 space per 350 sq. ft. based on the analysis provided. <br />Conditions of Approval: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. A tree bank payment of $16,100.00 must be submitted prior to the issuance of a Certificate of <br />Occupancy. <br />3. Provide copies of all local, regional, state, and federal permits for the project to the City prior to the <br />commencement of development. <br />4. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />A discussion ensued regarding the criteria used to determine the parking requirements, concerns that <br />overflow parking would impact the adjacent business, the traffic study, and concerns that the compact parking <br />spaces would be difficult for a person exiting the vehicle to receive emergency room services. <br />In response to the Commission's question, Ms. DeJesus reviewed the location of the outside seating area. <br />She said there would be a raised curb adjacent to the outside seating area. <br />In response to the Commission's question, Ms. DeJesus explained that the medical waste was not part of <br />the City's review as that is regulated by another agency. <br />site. <br />A general discussion ensued regarding the design of the crosswalks and the stormwater retention for the <br />Mr. Hale asked the applicant to come forward. Mr. George Huddleston, Catalyst Design Group, 941 West <br />Morse Boulevard, Winter Park, Florida came forward. Mr, Huddleston explained that the parking study is more of a <br />no similar use parking analysis. He said the use is not a medical office, a hospital with overnight stays, or an urgent <br />care facility. He said the study was submitted to the Institute of Traffic Engineers (ITE) and ITE reviewed the study <br />and adopted free-standing emergency room in their ITE Trip Generation Manual. He said he viewed a more recent <br />version of the manual that showed another study was added that corroborated those figures. <br />
