Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />December 14, 2022 <br />Page 3 <br />A discussion ensued regarding permitting of the previous dock, orientation of the dock on the lot, and dock <br />lighting. <br />Mr. Hale asked the applicant to come forward. Mr. Rickey Beard, 530 Lake Kathryn Circle, Casselberry, <br />Florida and Mr. Mike Caiazza, Specialty Marine Contractors, 229 Wood Lake Drive, Maitland, Florida came forward. <br />In response to the Commission's question, Mr. Beard said the dock was built in two phases and he did not <br />know when the dock was constructed. <br />Mr. Caiazza said most municipalities allow the dock to be built 10 feet to the right or left of their property. <br />He said the homeowner retains the right to their best view. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Hale asked for a motion to address CU 22-13. Ms. Divita made a motion that the Planning and Zoning <br />Commission approve case number CU 22-13 with staffs conditions, based upon the staff report and the testimony <br />and evidence presented, that the request meets the applicable provisions of the City Code of Ordinances (City Code) <br />and the Unified Land Development Regulations (ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, the eight (8) conditions of approval and Attachments A — C. Mr. <br />Bowman seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: SPR 22-19: Free -Standing Emergency Room at 2560 S US Hwy 17-92. A major site <br />plan request to redevelop the property located at 2560 S US Hwy 17-92 with a ±10,860 sq. ft. free-standing <br />emergency room, as well as associated hardscape, landscaping, and site lighting. <br />Ms. Antonia DeJesus, Planner II, reviewed the information provided in her memorandum dated December <br />14, 2022 to the City of Casselberry Planning and Zoning Commission. Ms. DeJesus explained that the Planned Unit <br />Development and rezoning were presented at the Planning and Zoning Commission meeting as 611 Dog Track <br />Road. She said the property has been readdressed to 2560 S US Hwy 17-92. Ms. DeJesus stated that all the <br />Development Review Committee's comments have been addressed. <br />Ms. DeJesus said staff recommends that the Planning and Zoning Commission approve case number SPR <br />22-19 based on the staff report and the testimony and evidence presented that the request meets the applicable <br />
