The variance shall only pertain to the proposed screen enclosure as shown in Attachment B. <br />2. The screen enclosure shall not exceed the height of the roof line of the principal structure. <br />3. A building permit shall be obtained prior to construction of the screen enclosure, within one year of <br />approval of the variance. <br />4. All of the above conditions shall be fully and faithfully executed, or the variance shall become null and <br />void. <br />In response to the Commission's question, Ms. Hyson explained that she is not aware of what information is <br />provided to future property owners. She stated that the property is considered legally noncompliant and the <br />structures are allowed to remain in its current form. She stated that when additions or improvements are added, it <br />increases the nonconformity and could potentially result in the proposed improvements being denied. The applicant <br />would need to meet the current code standards or it would increase the nonconformity. <br />A brief discussion ensued regarding that the applicant was aware that he purchased a noncompliant <br />property. The setback requirements at the time the structure was built were discussed. Ms. Hyson explained that <br />the 1966 zoning map shows property was zoned R-1AA and the earliest available zoning code from the 1970's <br />shows the required side yard setback was 10 feet. <br />Mr. Hale asked the applicant to come forward. Mr. Robert Phillips, 251 S Triplet Lake Drive, Casselberry, <br />Florida came forward. Mr. Phillips presented a PowerPoint Presentation (a copy of the presentation is attached and <br />made a part of the minutes). Mr. Phillips said the original setbacks were 5 feet when the house was constructed. He <br />said he has a letter from the adjacent neighbor endorsing the proposed project. No letter was provided to staff or the <br />Planning and Zoning Commission. <br />In response to the Commission's question, Mr. Phillips said he would replace the pool decking and relocate <br />and install new pool equipment. In response to the Commission's question, Mr. Phillips stated that the back of the <br />house is being reconfigured and there will be a partial roof added and the remaining would be a screen roof. He said <br />he wants to give the property a more contemporary look. He said the plans include enclosing the carport, adding a <br />garage, constructing a dormer over the front door, and constructing two covered patios. <br />
