Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 11, 2023 <br />Page 6 <br />A general discussion ensued regarding the size of the encroachment into the setback and a possible option <br />to construct the project without encroaching into the setbacks. He said he would like the proposed project to be <br />symmetrical to the existing home. A brief discussion ensued regarding the lack of a hardship for this project, the <br />minimum width of the property, the shape of the property, ownership of the lake bottom, and the slope of the rear <br />yard. <br />Mr. Phillips explained that the shape of his lot limits the best use of the property. <br />Mr. Tim Perry, architect, KLP Design,128 S Lakewood, Maitland, Florida came forward. Mr. Perry said the <br />lot does not conform to the R-12.5 restriction, He said the lot has an undersized width size of 74 feet through the <br />middle of the house. Mr. Perry said to alter it, it would cause some roof conditions which is not a hardship but it is an <br />issue on how the aesthetics would look on the back side of the house. He believed that the houses were staggered <br />to meet the 5 -foot setback. <br />In response to the Commission's question, Mr. Perry explained if the side setback was at 7.5 feet on the <br />west side of the pool, it would leave about 6 feet and would not be useable space. He said it would be an oversized <br />walkway. The proposed project would clean up the roof area on the back of the house and it would eliminate the <br />water runoff in the pool area. <br />A discussion ensued regarding alternative options that could be used to eliminate the need for a variance. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Mr. Kim Glaner, 261 S Triplet Lake Drive, Casselberry, Florida came forward to speak in favor of this <br />request. <br />Ms. Colleen Hufford, 527 Queens Mirror Circle, Casselberry, Florida came forward to speak against the <br />request. Ms. Hufford felt if the variance was granted it would set a precedent. Ms. Hufford asked if the enclosure of <br />the carport was prohibited. She said the City has numerous narrow lakefront properties and she was not sure how it <br />should be handled. <br />In response to the Commission's question, Ms. Hyson stated that tonight's agenda item is to review the <br />variance for the side yard setback for the rear of the house. Ms. Hyson also stated that Mr. Phillips indicated that the <br />carport would be converted to a garage. <br />
