Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 11, 2023 <br />Page 4 <br />7. The applicant shall comply and remain in compliance with all local, state, and federal law and <br />requirements. <br />8. All the above conditions shall be fully and faithfully executed, or the conditional use shall become null <br />and void. <br />Mr. McFerrin stated that condition number 5 was added to the conditions of approval after the staff report <br />was sent to the Planning and Zoning Commission. A brief discussion ensued regarding the office space being <br />utilized by the business and the conditional use process for the expansion of the use. <br />Mr. Hale asked the applicant to come forward. Mr. Eliseo Zendeli, 4345 Steed Terrace, Winter Park, Florida <br />came forward. In response to the Commission's question, Mr. Zendeli stated that he and his secretary would be <br />using their personal vehicles and there is no lettering on the vehicles. A brief discussion ensued regarding the <br />threshold required for a conditional use expansion. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Hale asked for a motion to address CU 22-15. Mr. Burnett made a motion that the Planning and Zoning <br />Commission approve case number CU 22-15 with staffs conditions, based upon the staff report and the testimony <br />and evidence presented, that the request meets the applicable provisions of the City Code of Ordinances (City Code) <br />and the Unified Land Development Regulations (ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, the eight (8) conditions of approval and Attachments A - C. Ms. <br />Saporito seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: BA 22-01: 251 S Triplet Lake Drive. A variance request to Section 2-5.4, Table 2-5.4 <br />of the Unified Land Development Regulations to allow a 3.9 -ft. encroachment into the required 10 -ft. side <br />yard setback at the property located at 251 S Triplet Lake Drive. <br />Ms. Christina Hyson, Chief Planner, reviewed the information provided in her memorandum dated January <br />11, 2023 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends that case <br />number BA 22-01 be denied and finds that based upon the staff report and the testimony and evidence presented, <br />the request does not meet the applicable provisions of the Unified Land Development Regulations as per the written <br />findings contained in the staff report. <br />If the Planning and Zoning Commission chooses to grant a variance to allow encroachment into the required <br />interior lot line setback for BA 22-01, for the property located at 251 S Triplet Lake Drive, the motion should be based <br />
