CASSELBERRY CiTY COMMISSION <br />Minutes of November 14, 2022 — Regular Meeting <br />Page 23 of 30 <br />National Pollutant Discharge Elimination System (NPDES) and a related NPDES permit with the Florida <br />Department of Environmental Protection (FDEP). The City's Code of Ordinances currently lacks sufficient <br />and clear illicit discharge restrictions which makes it difficult to enforce violations that may impact <br />waterbodies and other components of the City's municipal separate storm sewer system which could lead <br />to violatior, of the City's NPDES permit. This ordinance will allow the City to have increased legal <br />authority related to illicit discharges and connections to the City of Casselberry's separate storm sewer <br />system and through the regulation of non -storm water discharge, the City will be able to provide for better <br />health, safety, and general welfare to the citizens of the City of Casselberry. With implementation of the <br />ordinance the City will also have successfully satisfied its requirements as it relates to the City's NPDES <br />permit. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works & Utilities Director recommended adoption <br />of Ordinance 22-1577 on second and final reading. <br />Public Hearing: Vice Mayor Aramendia stated this was a public hearing to hear and consider comments <br />and questions regarding Ordinance 22-1577. Vice Mayor Aramendia opened the floor for public <br />participation. No one came forward to address Ordinance 22-1577. Vice Mayor Aramendia closed the <br />public hearing relative to Ordinance 22-1577. <br />MOTION: Commissioner Busch moved to adopt Ordinance 22-1577 on second and final <br />reading, as presented. Motion was seconded by Commissioner Albritton. <br />Motion carried unanimously by voice vote 4-0. <br />G. Second Reading of Ordinance 22-1578 — Amending the Future Land Use Map <br />Designation for the Property Located at 1398 State Road 436 (LPA 22-08) <br />The City Clerk read Ordinance 22-1578 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE <br />FUTURE LAND USE DESIGNATION FROM LOW INTENSITY NON-RESIDENTIAL/MEDIUM <br />DENSITY RESIDENTIAL TO MAJOR THOROUGHFARE MIXED-USE FOR ONE PARCEL, <br />TOTALING APPROXIMATELY 3.94 ACRES, LOCATED AT 1398 STATE ROAD 436, AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 22-1578 <br />was advertised in the Orlando Sentinel on Thursday, November 3, 2022. <br />Staff Presentation: Chief Planner Christina Hyson stated Ordinance 22-1578 amends the Future Land Use <br />Map (FLUM) designation from Low Intensity Non-Residential/Medium Density Residential (LINR/MDR) <br />to Major Thoroughfare Mixed -Use (MTMU) for one (1) parcel located at 1398 State Road 436.
