CASSELI EERY CITY COMMISSION <br />Minutes of November 14, 2022 — Regular Meeting <br />Page 22 of 30 <br />Staff Presentation: Deputy Police Chief Derrick Becton stated Ordinance 22-1576 amends the City of <br />Casselberry Code of Ordinances, Chapter 34, Emergency Services, Article II, Alarm Systems, Division 2, <br />Security Alarms to create definitions, clarify existing code, add an appeal process, and provide the Code <br />Enforcement Special Magistrate with jurisdiction over false alarm fee appeals. He noted that the proposed <br />changes had come about due to a staff review of the City's current regulations related to security alarms <br />which had identified a need for amendments in these areas, and the ordinance being submitted for adoption <br />at tonight's meeting had been drafted in concert with the City Attorney to address those issues. <br />Budget Impact: Adoption of Ordinance 22-1576 is not expected to have an impact on the budget. <br />Recommendation: The City Manager and the Police Chief recommended adoption of Ordinance 22-1576 <br />on second and final reading. <br />Public Hearing: Vice Mayor Aramendia stated this was a public hearing to hear and consider comments <br />and questions regarding Ordinance 22-1576. Vice Mayor Aramendia opened the floor for public <br />participation. No one came forward to address Ordinance 22-1576. Vice Mayor Aramendia closed the <br />public hearing relative to Ordinance 22-1576. <br />MOTION: Commissioner Meadows moved to adopt Ordinance 22-1576 on second and <br />final reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 4-0. <br />F. Second Reading of Ordinance 22-1577 — Illicit Discharge and Connections, <br />Amending Chapter 86, Utilities and Chapter 2 <br />The City Clerk read Ordinance 22-1577 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 86, <br />TO ADD ARTICLE VIII, SECTIONS 86-356 THROUGH 86-376, IMPLEMENTING INCREASED <br />LEGAL AUTHORITY OVER ILLICIT DISCHARGES AND CONNECTIONS TO THE CITY'S <br />MUNICIPAL SEPARATE STORM SEWER SYSTEM, CONFORMING STATE AND NATIONAL <br />REQUIREMENTS FOR POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMITS; <br />AMENDING SECTION 2-210, SCHEDULE OF VIOLATIONS TO INCLUDE A VIOLATION OF <br />SECTIONS 86-356 THROUGH 86-376; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 22-1577 <br />was advertised in the Orlando Sentinel on Thursday, November 3, 2022. <br />Staff Presentation: Natural Resources Officer Nick Cooper stated Ordinance 22-1577 provides for <br />amendments to Chapter 86, Utilities, of the City Code of Ordinances, to add Sections 356 through 376 to <br />provide increased legal authority to the City of Casselberry over illicit discharges and connections, while <br />also conforming to state and national requirements for pollutant discharge elimination system permit. <br />Chapter 2, Section 2-210 of the City Code of Ordinances is proposed to be amended, as well, to include a <br />schedule of related violations.
