CASSELBERRY CITY COMMISSION Minutes of November 14, 2022 — Rcgular Meeting Page 21 of 30 (LPA), voted unanimously at its meeting on August 10, 2022 to recommend approval of this item to the City Commission. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager recommended adoption of Ordinance 22-1575 on second and final reading. Public Hearing: Vice Mayor Aramendia stated this was a public hearing to hear and consider comments and questions regarding Ordinance 22-1575. Vice Mayor Aramendia opened the floor for public participation. No one came forward to address Ordinance 22-1575. Vice Mayor Aramendia closed the public hearing relative to Ordinance 22-1575. MOTION: Commissioner Busch moved to adopt Ordinance 22-1575 on second and final reading, as presented. Motion was seconded by Commissioner Meadows. Discussion: A brief discussion ensued regarding concerns about potential sound issues with the ordinance being amended from the requirement of a wall for screening to allowing just vegetation for screening. It was explained by staff that noise complaints would fall under the City's noise ordinance, but the ordinance was crafted so that a wall would be the preferred method of screening; however, in some cases, a wall would not be feasible, so landscaping would be allowed to meet the screening requirement. Also, going forward, if it should appear that there were any ongoing issues the Code could be amended to address those issues at that time. It was also noted that the screening requirements were most likely more for the purpose of screening the view of the business from residents rather than screening from noise. Motion carried unanimously by voice vote 4-0. E. Second Reading of Ordinance 22-1576 — Amending Chapter 34, Emergency Services Article II Alarm Systems Division 2 Security Alarms The City Clerk read Ordinance 22-1576 by title, as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 34, EMERGENCY SERVICES, ARTICLE 11, ALARM SYSTEMS, DIVISION 2, SECURITY ALARMS, OF THE CODE OF ORDINANCES TO ADD SECTIONS INCLUDING WAIVERS AND EXEMPTIONS AND AN APPEAL PROCESS, AND TO CLARIFY EXISTING CODE; AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS, COMMITTEES AND COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD, SECTION 2-149 TO PROVIDE THE SPECIAL MAGISTRATE WITH JURISDICTION OVER THE APPEALS; AMENDING ARTICLE V, CODE ENFORCEMENT CITATIONS, SECTION 2-210 TO INCLUDE A FALSE ALARM VIOLATION; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE."
