Vice Mayor Aramendia closed the <br />public hearing relative to Ordinance 22-1574. <br />MOTION: Commissioner Busch moved to adopt Ordinance 22-1574 on second and final <br />reading, as presented. Motion was seconded by Commissioner Meadows. <br />Motion carried unanimously by voice vote 4-0. <br />D. Second Reading of Ordinance 22-1575 — Amendment to Section 2-7.27, Vehicular <br />Services Maintenance and Light Mechanical Repair in the PMX-H and PMX-L <br />Zoning Districts of the City's Unified Land Development Regulations (LPA 2207) <br />- <br />The City Clerk read Ordinance 22-1575 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS, ARTICLE VII, GENERAL REGULATIONS, SECTION 2-7.27, VEHICULAR <br />SERVICES, MAINTENANCE, AND LIGHT MECHANICAL REPAIR IN THE PMX-H AND <br />PMX-L ZONING DISTRICTS, TO PROVIDE FOR REGULATIONS THAT ARE CONSISTENT <br />WITH DEVELOPMENT APPLICATIONS AND ECONOMIC DEVELOPMENT; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 22-1575 <br />was advertised in the Orlando Sentinel on Thursday, November 3, 2022. <br />Staff Presentation: Chief Planner Christina Hyson stated Ordinance 22-1575 amends Section 2-7.27, <br />Vehicular Services, Maintenance, and Light Mechanical Repair in the PMX-H and PMX-L Zoning <br />Districts, of the City's Unified Land Development Regulations (ULDR). Previous ordinances presented <br />tonight provided for a new land use type of large retail establishments both in Table 2-5.3 and the Oxford <br />Park Overlay District. There are existing performance standards within Section 2-7.27 that are specific to <br />vehicular services, maintenance, and light mechanical repair uses that are affiliated with a large major <br />retailer; however, these standards only apply within the PMX-H and PMX-L zoning districts. The proposed <br />ordinance will expand those performance criteria to apply to large retail establishment use rather than <br />specifically to vehicular services only in PMX-H and PMX-L. The proposed amendment revises the <br />performance standards to apply to large retail establishment land use rather than being tied to specific <br />zoning districts. There were some modifications that were made between first and second reading. First, <br />Section 2-7.27(2) was revised to include intensive landscaping as a potential method for screening vehicular <br />part sales and service areas from view of residential areas. Currently the ordinance provides for a wall, but <br />in some situations that may not be feasible or may not be the most compatible type of screening measure, <br />so this allows for intensive landscaping to be utilized. Additionally, the hours of operation were originally <br />proposed to be 7:00 a.m. to 7:00 p.m., seven (7) days per week, but based on feedback from the City <br />Commission, this has been modified to now state 7:00 a.m. to 7:00 p.m. Monday through Friday and 9:00 <br />a.m. to 7:00 p.m. Saturdays and Sundays. The final modification was just to add the specification that these <br />hours of operation are specific to the vehicular part sales and services areas, not to other aspects of a large <br />retail establishment.
