Initial Review of Development Agreement Request to Rezone Summerloch Green <br />Staff Presentation: Chief Planner Christina Hyson stated that consideration of initial review of a proposed <br />Development Agreement to rezone the Summerloch Green property and approval to complete the same for <br />assembled property located at 999 Mango Drive is requested. Summerloch Green is an existing mobile <br />home park. The subject property is approximately 94 acres and was annexed into the City in 1991. The <br />City's Future Land Use Map (FLUM) designation for the property was amended to City Medium Density <br />Residential in 2010; however, a City zoning designation was never adopted for the property. Therefore, <br />the current zoning of the site is reflected as Seminole County on the City's Official Zoning Map. The <br />Applicant submitted a written request to enter into a Development Agreement (DA) with the City for the <br />rezoning of the subject property in March 2021. In accordance with the City's ULDR Unified Land <br />Development Regulations (ULDR) requirements, the City Commission reviewed the request and voted to <br />proceed with negotiations for a Developer's Agreement on April 12, 2021. Following that vote, the <br />Applicant's representatives submitted the required documents, and the request was initially reviewed by <br />the City's Development Review Committee (DRC) in August of 2021. Since that time staff and the City <br />Attorney have been coordinating with the Applicant's representatives and legal counsel to negotiate the <br />terms and conditions of the Developer's Agreement. Once consensus was reached, the proposed <br />Developer's Agreement and the associated attachments were then routed to the DRC for review. The City's <br />DRC approved the Development Agreement on September 15, 2022. If the City Commission votes to <br />proceed with completion of the Developer's Agreement, the item will then go forward to the Planning and <br />Zoning Commission for review before being brought back to the City Commission for Final approval. In <br />response to a question from the City Commission regarding the number of lots in the development, Ms. <br />Hyson advised she did not currently have that information, but would provide it for the Commission when <br />the item comes back before them for approval. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended that the City Commission vote to proceed with <br />completion of the Development Agreement to rezone the Summerloch Green property, located at 999 <br />Mango Drive. <br />Audience Participation: No one came forward to address the City Commission regarding this item. <br />MOTION: Commissioner Busch moved to proceed with completion of the Development <br />Agreement to rezone the Summerloch Green property located at 999 Mango <br />Drive, as presented. Motion was seconded by Vice Mayor Aramendia. Motion <br />carried unanimously by voice vote 5-0. <br />13.
