An alarm <br />will be eensidefed valid only if it is the result of a reported <br />(de) Upon failure of the owner or lessee or manager of the Premises to pay the fee <br />specified in this Section within 30 calendar days following receipt of the statement, <br />the unpaid fee may be assessed as a lien upon the real property where the seems <br />alarm system is installed, pursuant to Article I11, cow 7, of the City Charter, <br />Article VI of the Code and F.S. § 166.021. The City may enforce its lien and <br />maintain a personal action against the property owner, lessee, and tenant at the <br />same time to recover the unpaid fee and any interest accrued thereon. In any action <br />brought by the City for the collection of the unpaid fee or lien, the City shall be <br />entitled to recover its actual costs, and attorney's fees and costs shall also attach as <br />a lien against the property. <br />See. 34-3142. - City not to be obligated to respond to alarms. <br />I t i Ttende�t d by- all -par-ties -subjeet to this that U Under no <br />circumstance is the City obligated to respond to an alarm. The City shall be held <br />harmless from any damage or loss to person or property caused by the City's failure <br />to provide service or respond to an alarm. <br />See. 34-43. Exemptions. <br />The Alarm Coordinator may adjust the count of false alarms at an Alarm Site if - <br />(a) a false alarm is caused by an act of God; <br />b) a false alarm is caused by the action of a telephone, cable, or other type <br />of communications company; <br />c) a false alarm is caused by a power outage; <br />d) documentary evidence is presented which indicates the alarm dispatch <br />request was not a false alarm; <br />(e) Police Department response to the Alarm Site was in excess of one hour; <br />or <br />f) documentary evidence is presented directly from the alarm repair <br />company that the alarm system is in the process of repair. <br />Ordinance 22-1576 <br />Page 5 <br />
