See. 34-44. Anneals. <br />a) An Alarm User may appeal the assessment of a fine to the City's Special <br />Magistrate for Code Enforcement. <br />b) Upon commencement of an appeal, an Alarm User shall submit an appeal fee of <br />30. Appeal fees will be returned to an Alarm User if the Special Magistrate rules in <br />favor of the appellant. <br />c) The filing of an appeal with the Special Magistrate stays the assessment of fines <br />until the Special Magistrate makes a final decision. However, it does not absolve the <br />owner, lessee, or manager from fixing the alarm system to prevent any further false <br />alarms. Subsequent false alarms will continue to be cited, and if the appeal is <br />unsuccessful. additional fines may be added. If the appeal is successful, the original <br />fines being appealed will be removed and any new false alarms will be recalculated <br />from the last false alarm being appealed and assessed accordingly. <br />(d) An Alarm User must file a written notice of appeal within 10 calendar days after <br />receipt of a fine for a false alarm to the Special Magistrate by setting forth the <br />reasons for the appeal. Failure to file a notice of appeal within the 10 -day period shall <br />operate as a bar for review. <br />(e) The City's case will be presented by a Code Enforcement Officer. If the Special <br />Magistrate denies an Alarm User's appeal, the Special Magistrate shall send written <br />notice of the action and a statement of the right to an appeal to the appellant or Alarm <br />User and the alarm company. <br />fl The decision of the Special Magistrate may be appealed to the courts. <br />Sec. 34-4045-34-50. Chapter 2, Administration, Article IV, Boards, Committees and Commissions, <br />Division 2, Code Enforcement Board, Section 2-149, Special magistrate selection; qualifications; <br />compensation; duties and powers; policies, Subsection d, of the Code of Ordinances of the City of <br />Casselberry is amended as follows: <br />Sec. 2-149. — Special magistrate selection; qualifications; compensation; duties and <br />powers; policies. <br />(d) Duties and powers. Special Magistrates shall have the same duties, powers, <br />and limitation on powers as those conferred on the Board under this Article, as the <br />context permits.
