WHEREAS, amendments to Section 2-5.2 and Section 2-5.3 includes adding Mid -rise <br />dwellings with mixed -uses as a Permitted use within zoning districts that have the future land use <br />designations, infrastructure, and are similarly situated to accommodate the uses with higher <br />densities and intensities; and <br />WHEREAS, the City also desires to amend Section 2-5.4, Size and Dimension Criteria <br />and Chapter V, Glossary, Article XXI, Language and Definitions, Section 5-21.2, Definition of <br />Terms, for consistency, while increasing density and intensity in the PMX-HIGH zoning district; <br />and <br />WHEREAS, Exhibit "A" Amendments to Table 2-5.3 Land Use by District and Exhibit <br />"B" Amendments to Table 2-5.4, Size and Dimension Regulations, identified in this Ordinance, are <br />incorporated herein by reference and made a part hereof of this Ordinance; and <br />WHEREAS, land uses that are lawful uses at the time of the effective date of this <br />Ordinance shall remain legally conforming uses and shall be exempt from this Ordinance. The <br />City shall provide Bert J. Harris Act notices to businesses when it anticipates that amendments to <br />this Ordinance warrant such notice; and <br />WHEREAS, the proposed amendments to the ULDRs are consistent with the City's <br />Comprehensive Plan and State of Florida Growth Management Act; and <br />WHEREAS, words with underlined type shall constitute additions to the original text and <br />strike *h,.,,,,,,i, type shall constitute deletions to the original text, and asterisks (* * *) indicate that <br />text shall remain unchanged from the language existing prior to adoption of this Ordinance; and <br />WHEREAS, the City Commission of the City of Casselberry, hereby finds this Ordinance <br />to be in the best interest of the citizens of Casselberry's public health, safety, and welfare. <br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. LEGISLATIVE FINDINGS. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. The City Commission finds and determines that there <br />is competent substantial evidence to support the findings and determinations made in this Section. <br />SECTION II. AMENDMENT OF ARTICLE V, ZONING DISTRICT <br />REGULATIONS, SECTION 2-5.2. Chapter Il, District and General Regulations, Article V, <br />Zoning District Regulations, Section 2-5.2, Purpose and Intent of Zoning Districts, of the ULDRs <br />of the City of Casselberry, Florida, is hereby amended to read: <br />Section 2-5.2. Purpose and Intent of Zoning Districts <br />*** <br />c. Planned Mixed -Use: High -Rise (PMX-HIGH) zoning districts. Development within the <br />PMX-HIGH zoning district shall provide for general retail and service commercial activities <br />as well as attached residential units. The maximum land use intensity shall be 4-50 2.0 floor <br />area ratio (FAR) and the gross residential density shall not exceed �0 80 dwelling units per <br />acre (DUA).
