WHEREAS, the City desires to amend Section 2-5.2, Purpose and Intent of Zoning <br />Districts, and Section 2-5.3, Land Use by District, to correct inconsistent land use regulations to <br />create new land use categories to address changing market conditions; to eliminate uses from <br />certain districts where inconsistent with the ULDRs and the City's redevelopment goals, while <br />recognizing the vested rights of existing businesses; to create more opportunities for desirable <br />redevelopment within the PMX-HIGH zoning district; to ensure schools and public property are <br />protected from close proximity to medical marijuana dispensing facilities, which must be regulated <br />like Pharmacies under the preemption provisions of Florida Statutes 381.986; and <br />WHEREAS, amendments to Section 2-5.2 and Section 2-5.3 for Permitted and <br />Conditional Uses include deleting Multiple -Family Dwellings from the CG zoning district to meet <br />the purpose and intent listed for only general commercial uses in that district; adding Mid -Rise <br />Dwellings with Mixed -Uses as a Permitted use in the PMX-H, PMX-MID, and PMX-HIGH <br />zoning districts that are similarly situated to accommodate uses with higher densities and <br />intensities; adding Administrative Services as a Permitted use in the PS zoning district to <br />accommodate public benefit uses; adding Child or adult care facilities as a Permitted use in the <br />PMX-MID and PMX-HIGH zoning districts to meet demand for these community facilities; <br />deleting Cultural or Civic Activities as a Conditional use, as it is included in the Community Center <br />land use; deleting Amusement (unenclosed) as a Conditional use because the City does not have <br />this land use; deleting Boat Sales as a Conditional use in the CG and CS zoning districts and adding <br />it to the I and IM zoning districts as a Permitted use to accommodate parcel sizes for this use; <br />adding Car washes as a Permitted use in the I and I -M zoning districts that can accommodate the <br />use; adding Commercial Kitchen as a Permitted use in the CG, CS, 1, I -M, PMX-H, PMX-MID, <br />and PMX-HIGH zoning districts to meet market demand for takeaway food preparatory facilities <br />in and near commercial uses; adding Large Retail Establishment as a Permitted use in the CG, <br />PMX-H, PMX-MID, and PMX-HIGH zoning districts to accommodate the land use in commercial <br />areas; adding Micro -Brewery and Micro -Winery in the CG, CS, 1, I -M, PMX-H, PMX-MID, and <br />PMX-HIGH zoning districts as a Permitted use as potential commercial uses; deleting Medical <br />Services from the OR and CL zoning districts and adding it as a Permitted use to the I and I -M <br />zoning districts that can accommodate the use; removing the Restaurants (including drive-ins) and <br />fast food land use and adding a Drive-through establishment land use as a Conditional use in the <br />CG, CS, PMX-H, PMX-MID, and PMX-HIGH zoning districts to accommodate additional uses <br />that may utilize drive-throughs; deleting Vehicular Sales, Service, and Leasing from the CG and <br />CS zoning districts and adding it to the I and I -M zoning districts to accommodate the land use; <br />deleting Vehicular Service or Vehicular Leasing and combining it with the aforementioned land <br />use; deleting Vehicular Services, Maintenance and Light Mechanical Repair from the PMX-L <br />zoning district as that is a residential area and because the performance standards have been <br />eliminated; amending Veterinary Medical Services to remove the Conditional use designation in <br />the PMX-L zoning district and changing the Conditional use to a Permitted use in the CG and CS <br />zoning districts for land use compatibility; deleting Veterinary Medical Services with Outside <br />Kennels and combining it with the aforementioned land use; deleting Television and Radio <br />Broadcasting as a Conditional use in the CG, CS, PMX-L, and PMX-H zoning districts where the <br />parcels do not accommodate transmittal dishes and towers; deleting Bakery as a Conditional use <br />in the CL and PMX-H zoning districts; deleting Self -Storage Multi -Access as a Permitted use in <br />the CS zoning district; and deleting Trades and skilled services with outside storage as a Permitted <br />use in the CS, I, and I -M zoning districts; and <br />Page 2 <br />Ordinance 22-1573 <br />
