CASSELBERRY CITY COMMISSION <br />Minutes of October 10, 2022 — Regular Meeting <br />Page 7 of 11 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE <br />ZONING CLASSIFICATION OF R-12.5 (LOW DENSITY SINGLE-FAMILY) FOR <br />APPROXIMATELY 0.81 ACRES LOCATED AT THE NORTHEAST CORNER OF LOTUS <br />LAKE DRIVE AND ANCHOR ROAD, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 22-1571 was advertised in <br />the Orlando Sentinel on Thursday, September 29, 2022. <br />Staff Presentation: Planner Il Antonia DeJesus stated Ordinance 22-1571 provides for establishing the <br />official zoning designation of R-12.5 (Low Density Single -Family) for one (1) parcel located at the <br />northeast corner of the intersection of Lotus Lake Drive and Anchor Road. The property was annexed into <br />the City in 2010 and the Future Land Use Map (FLUM) designation was amended to Low Density <br />Residential later that year; however, the property's zoning was not amended to a City zoning designation <br />following the annexation and future land use change. The subject property is approximately 0.81 acres in <br />size and is currently vacant. The applicant is representing a client that is interested in purchasing the <br />property to build a single-family residence, and an amendment to the City's Official Zoning Map to the R- <br />12.5 zoning district for the subject property is necessary to establish permitted land uses and size and <br />dimension criteria to develop the property. Written notice for the Official Zoning Map amendment was <br />posted on the subject property on July 28, 2022 and letters notifying the surrounding property owners within <br />500 feet were mailed on July 29, 2922. The Planning and Zoning Commission, acting as the City's Local <br />Planning Agency (LPA) voted unanimously at its meeting on August 10, 2022 to recommend approval of <br />this item to the City Commission. The request to amend the Official Zoning Map to establish the zoning <br />classification of R-12-.5 (Low Density Single -Family) for the subject property is consistent with the City's <br />Comprehensive Plan and the Low -Density Residential Future Land Use designation; compatible and <br />consistent with the adjacent land uses and zoning districts; and connections for City water and sanitary <br />sewer services are available to the subject property. In response to a question from the City Commission, <br />Ms. DeJesus advised that a few of the surrounding properties had made inquiries about what could possibly <br />be developed on the site and were advised that the R-12.5 zoning district was intended for single family <br />conventional detached residential development. There are some conditional uses that are allowed, but that <br />would of course require additional approvals. All the documentation provided by the applicant, including <br />school impact analysis and utility capacity was based on a single-family home. Ms. DeJesus advised that <br />the surrounding property owners who had inquired and those who had attended the Planning and Zoning <br />Commission meeting had expressed that they were happy with that information. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Ordinance 22-1571 on second and final <br />reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 22-1571. Mayor Henson opened the floor for public participation. No one <br />carne forward to address Ordinance 22-1571. Mayor Henson closed the public hearing relative to <br />Ordinance 22-1571. <br />
