CASSELBERRY CITY COMMISSION <br />Minutes of September 12, 2022 — Regular Meeting <br />Page 7 of 25 <br />CASSELBERRY COMPREHENSIVE PLAN FUTURE LAND USE ELEMENT, TABLE FLU 1: <br />LAND USE AND CORRESPONDING ZONING DISTRICTS FOR THE MAJOR <br />THOROUGHFARE MIXED-USE LAND USE CATEGORY AND PLANNED MIXED-USE: HIGH <br />RISE ZONING DESIGNATION AND POLICY FLU 1.5, IN ACCORDANCE WITH CHAPTER <br />163, FLORIDA STATUTES TO UPDATE BASED ON MARKET CONDITIONS; PROVIDING <br />FOR VESTING OF LAND USES, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to first reading of Ordinance 22-1572 <br />was advertised in the Orlando Sentinel on Thursday, September 1, 2022. <br />Staff Presentation: Chief Planner Christina Hyson stated that Ordinance 22-1572 amends the City's <br />Comprehensive Plan Future Land Use Element to accommodate increased densities and intensities within <br />the Major Thoroughfare Mixed -Use (MTMU) future land use designation and the corresponding PMX- <br />HIGH (Planned Mixed -Use: High Rise) zoning designation. These amendments would apply only to <br />development along the City's major arterial corridors of U.S. Highway 17-92 and State Road (SR) 436. <br />The proposed amendment modifies Table FLU 1: Land Use and Corresponding Zoning Districts and Policy <br />FLU 1.5 Major Thoroughfare Mixed -Use within the City's Comprehensive Plan. The amendment to Table <br />FLU I is only to the MTMU (Major Thoroughfare Mixed -Use) land use category and the corresponding <br />PMX-HIGH (Planned Mixed -Use: High Rise) zoning district to revise the standards to accommodate <br />increased densities and intensities. The proposed density under this amendment will increase from 30 to <br />80 dwelling units per acre and the proposed intensity will increase from 1.5 to 2.0 FAR (Floor Area Ratio). <br />The proposed changes will accommodate development within the City, including the new land use category <br />of mid -rise dwellings with mixed uses. The Planning and Zoning Commission, acting as the City's Local <br />Planning Agency (LPA), voted unanimously at its meeting on August 10, 2022 to recommend approval of <br />this item to the City Commission. Because this is a Comprehensive Plan text amendment, if approved on <br />first reading, the proposed amendment to the City's Comprehensive Plan will be transmitted to the <br />Department of Economic Opportunity (DEO) for review. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Ordinance 22-1572 on first reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 22-1572. Mayor Henson opened the floor for public participation. The <br />following individuals came forward to address Ordinance 22-1572: <br />1. Doug Markovitz, co-owner of Casselberry Liquor, 130 SR 436, spoke in favor of increasing <br />density, redevelopment, and modernization of the City, but expressed concerns about allowing <br />large scale retail businesses in the City, as he felt this was detrimental to the City's small <br />business owners. <br />2. Ed Williams of Williams Development Services, 29 E. Pine Street, Orlando, stated he <br />represented one of the property owners at the northwest corner of U.S. Highway 17-92 and <br />State Road 436 and felt that although the flyover had solved some of the area's traffic problems, <br />it had also created some problems with developing the area due to visibility issues. <br />3. Brad Markovitz, co-owner of Casselberry Liquor, 130 SR 436, agreed that the flyover had <br />solved some of the traffic issues, but expressed concerns about the City's need for revitalization <br />and the detrimental effect of large retail establishments. <br />
