CASSELBERRY CITY COMMISSION <br />Minutes of September 12, 2022 — Regular Meeting <br />Page 6 of 25 <br />Future Land Use Map (FLUM) designation of Major Thoroughfare Mixed -Use (MTMU). The applicant <br />is requesting an amendment to the Official Zoning Map to rezone the property to PMX-MID (Planned <br />Mixed Use: Medium Rise) in order to correct the inconsistency so that the site can be redeveloped. The <br />proposed zoning district, PMX-MID, is classified as a Planned Unit Development (PUD) zoning district <br />and must therefore adhere to the requirements of Article XX, Planned Unit Development, of the Unified <br />Land Development Regulations (ULDR). In addition to following the standard zoning map amendment <br />procedures established in Section 66-58 and Section 1-2.9 of the ULDR, all PUD applications require the <br />submission of a concept plan and the execution of a PUD Agreement as part of the rezoning process. The <br />proposed PUD Agreement is included as Attachment B to Ordinance 22-1570. Notification was provided <br />to the surrounding property owners within 500 feet on June 28, 2022 and written notices for the Official <br />Zoning Map amendment were posted at the subject property on June 29, 2022. The Planning and Zoning <br />Commission, serving as the City's Local Planning Agency (LPA), voted unanimously at its meeting on July <br />13, 2022 to recommend approval of this item to the City Commission. The request to amend the Official <br />Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for the <br />subject property is consistent with the City's Comprehensive Plan and the Major Thoroughfare Mixed -Use <br />Future Land Use designation; compatible and consistent with the adjacent land uses and zoning districts; <br />and connections for City water and sanitary sewer services are available to the subject property. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended adoption of Ordinance 22-1570 on second and final <br />reading and approval of the associated PUD (Planned Unit Development) Agreement. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 22-1570. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 22-1570. Mayor Henson closed the public hearing relative to <br />Ordinance 22-1570. <br />MOTION: Vice Mayor Aramendia moved to adopt Ordinance 22-1570 on second and <br />final reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 4-0. <br />Chief Planner Christina Hyson gave a brief overview of the amendments being proposed in the next four <br />related ordinances being presented for consideration on first reading, noting that the amendments proposed <br />in these ordinances were for the purpose of supporting, promoting, and assisting economic development <br />and redevelopment in the City. She also advised that the ordinances had been prepared after a review of <br />the City's Comprehensive Plan and Unified Land Development Regulations (ULDR), and after staff had <br />been directed by the City Commission at its July 25, 2022 regular meeting to proceed with preparation of <br />the ordinances. <br />D.
