CASSELBERRY CITY COMMISSION
Minutes of September 12, 2022 — Regular Meeting
Page 15 of 25
and the Future Land Use Map designation was amended to Low Density Residential later that year;
however, at that time the zoning was not amended to a City zoning designation following the annexation
and future land use change so this proposed amendment will establish a City zoning designation of R-12.5
(Low Density Single -Family). The subject property is approximately 0.81 acres in size and is currently
vacant. The applicant represents a client who is interested in purchasing the property for the purpose of
building a single-family home. The R-12.5 zoning district is intended to accommodate conventional single-
family permanent residential development. An amendment to the City's Official Zoning Map is necessary
to establish permitted land uses and size and dimension criteria to develop the property per the City's
Unified Land Development Regulations (ULDR). Written notice for the Official Zoning Map amendment
was posted on the subject property on July 28, 2022 and letters notifying the surrounding properties within
500 feet were mailed on July 29, 2022. The Planning and Zoning Commission, acting as the City's Local
Planning Agency (LPA), voted unanimously at its meeting on August 10, 2022 to recommend approval of
this item to the City Commission. The request to amend the Official Zoning Map to establish the zoning
classification of R-12.5 (Low Density Single -Family) for the subject property is consistent with the City's
Comprehensive Plan and the Low -Density Residential Future Land Use designation; is compatible and
consistent with the adjacent land uses and zoning districts; and connections for City water and sanitary
sewer services are available to the subject property.
Budget Impact: There is no impact to the City Budget.
Recommendation: The City Manager recommended approval of Ordinance 22-1571 on first reading.
Audience Participation: No one came forward to address Ordinance 22-1571.
MOTION: Vice Mayor Aramendia moved to approve Ordinance 22-1571 on first
reading, as presented. Motion was seconded by Commissioner Busch. Motion
carried unanimously by voice vote 4-0.
9. CONSENT AGENDA
A. Approval of Legal Services Invoices
Introduction: Approval of the legal services invoices from the City Attorney and the City Labor Attorney
is requested.
Discussion: The following invoices have been reviewed by the affected departments and are being
presented for approval:
Garganese, Weiss, D'Agresta & Salzman, P.A.
City Attorney Services for August 2022
• Invoice No. 94872 $ 16,893.90
Fisher & Phillips, LLP
City Labor Attorney Services for July 2022
0 Invoice No. 1695144 $ 118.00
