First Reading of Ordinance 22-1575 — Amendment to Section 2-7.27 Vehicular <br />Services, Maintenance, and Light Mechanical Repair in the PMX-H and PMX-L <br />Zoning Districts, of the City's Unified Land Development Regulations (LPA 22 - <br />The City Clerk read Ordinance 22-1575 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS, ARTICLE VII, GENERAL REGULATIONS, SECTION 2-7.27, VEHICULAR <br />SERVICES, MAINTENANCE, AND LIGHT MECHANICAL REPAIR IN THE PMX-H AND <br />PMX-L ZONING DISTRICTS, TO PROVIDE FOR REGULATIONS THAT ARE CONSISTENT <br />WITH DEVELOPMENT APPLICATIONS AND ECONOMIC DEVELOPMENT; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to first reading of Ordinance 22-1575 <br />was advertised in the Orlando Sentinel on Thursday, September 1, 2022. <br />Staff Presentation: Chief Planner Christina Hyson stated Ordinance 22-1575 amends Section 2-7.27, <br />Vehicular Services, Maintenance, and Light Mechanical Repair in the PMX-H and PMX-L Zoning <br />Districts, of the City's Unified Land Development Regulations (ULDR). Previous ordinances presented <br />tonight provided for a new land use type of large retail establishments in Table 2-5.3 and the Oxford Park <br />Overlay District. Large retail establishments as a principal use are typically accompanied by retail tire sales <br />and stand-alone fuel pumps. There are existing performance standards within Section 2-7.27, but these are <br />specific to vehicular services, maintenance, and light mechanical repair and only within the PMX-H and <br />PMX-L zoning districts. The proposed ordinance will expand those performance standards to apply to large <br />retail establishments within any zoning district in which they're permitted so the standards will not be <br />specific only to PMX-L and PMX-H zoning districts, and not just to vehicular services. This will also help <br />to ensure compatibility and minimize any incompatibilities with adjacent land uses. The Planning and <br />Zoning Commission, acting as the City's Local Planning Agency (LPA), voted unanimously at its meeting <br />on August 10, 2022 to recommend approval of this item to the City Commission. <br />Discussion: In response to concerns expressed by Commissioner Meadows regarding potential noise and <br />visual impacts of a business offering tire services on adjacent property owners and residences, Ms. Hyson <br />explained that if there is redevelopment of a site and the zoning is not consistent with future land use <br />designation, the property has to be rezoned and depending on where the property is located, it may or may <br />not require a Planned Unit Development (PUD) rezoning which would be the first review of the concept <br />plan and the proposed arrangement of buildings on the site. Given the zoning districts for which large retail <br />establishments are permitted, CG (Commercial General) is not a PUD district, but PMX-H, PMX-MID, <br />and PMX-HIGH are, so there would be a review of buffers and building setbacks during the PUD process. <br />
